Pursuant to 6 NYCRR Part 375 of the Environmental Conservation Law or notice requirements of ß202 (1) of the State Administrative Procedures Act, or both such statutes, the Department of Environmental Conservation hereby gives notice of the following:

A public meeting and extension of the comment period for the Draft Remedial Action Work Plan (RAWP) for East 173rd Street Works (Starlight Park) Bronx Former MGP Site. The RAWP describes the proposed remedy which the New York State Department of Environmental Conservation (NYSDEC) and New York State Department of Health (NYSDOH) has found to be approvable for the site and it is now available for public review and comment. The comment period for this document has been extended until March 25th, 2004. The RAWP is available for review at the following locations:

Notice of Public Meetings

New York State Department of Environmental Conservation

Pursuant to Environmental Conservation Law Section 27-0926, as enacted by Chapter 506, Laws of 2002, the New York State Department of Environmental Conservation (NYSDEC) hereby gives notice of the following:

Preliminary Draft for 6 NYCRR, Subpart 374-4 - Standards for the Management of Elemental Mercury and Dental Amalgam Wastes at Dental Facilities.

The NYSDEC will hold public workshops on the preliminary draft of proposed regulations to add a new Subpart 374-4 and associated changes to Part 364, Part 370, Part 371, and 374 of Title 6 of the Official Compilation of Codes, Rules and Regulations (6 NYCRR) of the State of New York.

The preliminary draft regulation proposes to establish waste management standards for dental facilities that use mercury or generate mercury-containing dental amalgam wastes. It would also propose requiring dental facilities where mercury dental amalgam is placed or removed to install, properly operate and maintain mercury amalgam separation and collection equipment.

The draft preliminary regulation can be accessed on the NYSDEC website at: www.dec.state.ny.us/website/dshm/redrecy/mercdent.htm, or by contacting James Honan, of the Bureau of Solid Waste, Reduction & Recycling, at (518) 402-8705. In addition, copies of the preliminary regulation are available for public inspection in the Departmentís main office at 625 Broadway, Albany, New York 12233, and in each of the Departmentís nine Regional Offices from the Regional Solid & Hazardous Materials Engineer.

All those that may be affected by the preliminary regulation are invited to attend the workshops and to also submit written comments. The NYSDEC is looking for comments and specific input regarding how businesses, local governments, environmental groups, and other interested parties may be impacted by the proposed regulation. This input can include any cost estimates, projected environmental or economic benefits, technical or other concerns.
