The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application. The facility operates three dual-fuel (natural gas and #6 fuel oil)
boilers. If all three boilers were used concurrently and continuously with #6 fuel oil, the
emissions of oxides of nitrogen (NOx) and sulfur dioxide (SO2) would exceed the major
facility thresholds for both contaminants. This permit contains conditions which limit the
facility's ability to emit NOx and SO2 to less than the major facility threshold value of
100 tons per year of each contaminant. The NOx emissions from the boilers have also
been capped below the applicability thresholds of 6 NYCRR Part 227-2 - RACT
(reasonably available control technology) for NOx. This permit would replace the
facility's Title V permit, which had been required due to the operation of a medical waste
incinerator at the hospital, which has since permanently ceased operation. The
application, draft permit, relevant supporting materials and regulations are available for
review during normal business hours at the DEC office provided in this notice.

The Department has drafted
a revised permit pursuant to Article 19 ( Air Pollution
Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal
Clean Air Act Amendments, and has made a tentative determination to approve this
application for modification of the existing facility-wide Air Title V permit for the
applicant's manufacturing operations located at 400 Main Street, Arcade, NY. The draft
permit, applicable regulations, and application are available for review at the
Departments Region 9 Office, Buffalo N.Y. This application for modification
incorporates the installation of a new emission unit, identified as P00009. Emission Unit
P00009 will include the installation of 9 diesel engine test stands to test starter motors
manufactured at the facility. The Department reviewed this project as a potential major
source at an existing nonmajor facility for oxides of nitrogen (NOx) emissions, as
specified in 6NYCRR Part 231-2, New Source Review. NOx emissions from this new
emission unit are limited to 50 tons during any 12 month period. The draft modified
permit also includes the establishment of VOC emission reduction credits (ERCs) of 4.5
tons per year for the permanent discontinuation of a trichloroethylene vapor degreaser.
The modified permit also includes installation of new equipment which is similar to
existing equipment. The new equipment is subject to the existing monitoring, reporting,
recordkeeping and control requirements and does not change existing permit conditions.
Comments of support or objection may be made by filing a written statement by the
deadline date indicated. The Department may schedule a public hearing based upon an
evaluation of the nature and scope of written objections raised. Hearing Notices, if
necessary, will provide instructions on filing for party status and submitting comments.
In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the
United States Environmental Protection Agency (USEPA) has the Authority to bar
issuance of any Title V permit if it is determined not to be in compliance with applicable
requirements of the Clean Air Act or 6NYCRR Part 201.
In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201. Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. It is recommended that an appointment be made to confirm the availability of the subject files. The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. A public hearing may be legislative or adjudicatory. A legislative public hearing is a proceeding which provides an additional opportunity for public comment. DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists. If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments. The applicant and all persons who have filed comments on the permit will be notified by mail of the public hearing. Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below. An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination. An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist.
