Pawling
Properties, LLC proposes to reconstruct and increase the height of an
existing earthen embankment dam at the location of a pre-existing smaller dam on its
property. The reconstructed dam would be approximately 226 feet long by 33 feet high,
consisting of approximatley 7400 cubic yards of earthen fill. The proposed higher dam
would raise the water elevation in the West Pond 15.7 feet from its previous water
elevation and will expand the pond from 7.6 acres to approximately 19 acres in size, at
normal water elevation. The West Pond is located off Reservoir Road, near its
intersection with Dewey Road, in the Town of Pawling, Dutchess County, NY.

of Environmental Conservation (DEC) has
received an application to re-issue the following EPA minor
Private/Commercial/Institutional State Pollutant Discharge
Elimination System (P/C/I SPDES)permit. DEC has made a
tentative determination to re-issue this permit for a five-year period, maintaining the current effluent
limitations
and monitoring and reporting requirements. This permit
involves the surface discharge of up to 1400 gallons per
day of treated sanitary waste to the Wappingers Creek.

The
Rockland County Sewer District No. 1 has proposed to construct a wastewater
treatment plant (WWTP) with a minimum treatment capacity of 1.5 million-gallons-per-day (mgd) (maximum
of 5.0 mgd) on a site along the abandoned entry ramp to State
Route 17 in the Village of Hillburn. Treated wastewater will be discharged to the
Ramapo River. The 1.5 mgd WWTP capacity will serve the Villages of Sloatsburg,
Hillburn, a portion of the unincorporated Town of Ramapo, and Tuxedo Mountain
Apartments, and replaces subsurface disposal systems, many of which are failing, and
older wastewater treatment plans. The 1.5 mgd capacity is based on serving the existing
and future needs of Western Ramapo utilizing current zoning limitations. The maximum
size WWTP of 5.0 mgd may be constructed in the future to process an additional 3.5 mgd
of wastewater from currently sewered areas within the Sewer District in the Town of
Ramapo which presently flows to the wastewater treatment plant in Orangeburg and
discharges to the Hudson River.
Construction
of new sewer lines to serve these areas will require work within the State
Freshwater Wetland SL-9 (Class III) and its 100 foot adjacent area, and the 100 foot
adjacent area of State Freshwater Wetland SL-7 (Class II). Portions of the new sewer
system will also be constructed within the Wild, Scenic and Recreational River Corridor
of the Ramapo River. Sewer line crossings of several State regulated streams are also
proposed for the Ramapo River (two locations), Nakoma Brook (five locations), Stony
Brook and tributary 2 of the Ramapo River.
The
NYS DEC has made a tentative decision to approve the SPDES permit for the new
Western Ramapo WWTP. A draft SPDES permit containing proposed effluent limits and
monitoring requirements that DEC staff believe are required to meet regulatory standards
has been prepared. A "Fact Sheet" has also been prepared that identifies DEC's basis
for
the effluent limits and requirements in the draft permit. Two discharge outfall locations
to the Ramapo River are proposed. Discharge outfall 001 will be located in the
immediate vicinity of the WWTP, just upstream of the regulatory weir in the river.
Discharge outfall 002 is located approximately 1000 feet upstream of the United Water
wellfield. The County proposes to use outfall 002 to supplement river flows in order to
allow the wellfield to continue to be used during low flow periods. In addition, the
County has requested that outfall 003 be authorized to allow wastewater to be diverted to
the Orangeburg WWTP should the Western Ramapo WWTP have operational problems.
As
a tentative determination, DEC seeks comments on the draft SPDES permit and the
applications for other DEC permits required by the County for this project. The draft
SPDES permit, Fact Sheet and other application materials are available for review at the
Region 3 office of DEC.
