Negative Declaration

Cattaraugus County - The NYS Department of Environmental Conservation, as lead agency, has determined that the proposed Clearcut of 63 Acres on Cattaraugus RA#7, Stand 80 will not have a significant adverse environmental impact. The action involves the harvest of 63 acres of red pine which is 46 years old. The growth of the red pine has slowed and also has sustained damage from numerous ice and wind storms, the last occurring in November 2003 (some mortality has occurred). The project is located in the Town of Lyndon six miles east of the Village of Franklinville.

Erie County - The Town Of Amherst Town Board, as lead agency, has determined that the proposed Rezoning of 4845-A Millersport Highway will not have a significant adverse environmental impact. The action involves the rezoning of 12.1 acres of land from Suburban-Agriculture (SA) and Residential District Two (R-2) to Research-Development (RD). The petitioner is Veritay Technology, Inc., 4845 Millersport Highway, East Amherst, New York 14051.

The property is located on the east side of Millersport Highway, approximately mid-way between the intersections of New and Transit Roads. Veritay Technology has been conducting its research and development business at the subject site for 20 years under temporary use permits. Veritay is now requesting the rezoning in order to bring the subject property into conformance with the Zoning Ordinance and thereby eliminate the need for the temporary permits. The property is directly adjacent to land owned by the Town of Amherst; the two properties together comprise the former U.S. Army Nike Base.

Erie County - The Town of Marilla, as lead agency, has determined taht the proposed Creation of Water District No. 5 of the Town of Marilla will not have a significant adverse environmental impact. The action involves the construction of a water distribution system consisting of the installation along Clinton Street, Exchange Street and Cayuga Creek Road in the Town of Marilla of approximately 15, 050 linear feet (LF) of water lines and the necessary valves, hydrants and appurtenances, including land or rights in land. The water lines will be constructed along Clinton Street, Exchange Street and Cayuga Creek Road in the Town of Marilla, County of Erie, New York.

Positive Declaration

Erie County - The Town of Wheatfield Town Board, as lead agency, has determined that the proposed Shawnee Meadows Subdivision may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves the approval and construction of a major subdivision consisting of 82 single-family residential lots and associated roadways, drainage structures and public utilities (sanitary sewers, water, electric, natural gas, etc.) within an 84+/- acre parcel. The project site is zoned rural residential. The project is located east of and adjacent to Schultz Road, south of Moyer Road, and west of Shawnee road in the Town of Wheatfield, Niagara County, New York.
