ENB Region 3 Completed Applications 01/28/2004

The applicant proposes to extend the service area of the Farms Water Company to serve a proposed 34-lot residential subdivision, the Plum Court Development, via connection to an existing private water supply, treatment, storage and distribution system. The proposed expansion of the Farms Water Company service area will not result in an increase in water taking, currently permitted at a daily maximum of 311,000 gallons per day (gpd). The project is located on the north side of Beekman Poughquag Road (County Route 7), west of Main Street in the hamlet of Poughquag, Town of Beekman.

The Department has made a tentative determination to approve this application for a new SPDES permit (SPDES # NY-0268046) to allow the surface discharge of up to 2,850 gallons of treated sanitary wastewater per day from one outfall to an unnamed Tributary of Shawangunk Kill (Index # H-139-13-9-25, Class B).  Construction of the outfall structure will require a  Protection of Waters permit Article 15, Title 5 Stream Disturbance.  

The proposed Wastewater Treatment Facility will serve a proposed Church, Office Complex and Day Care Facility.  A draft permit containing proposed effluent limits and monitoring requirements has been prepared by the Department for this discharge.  This project is located on the south side of M & M Road approximately 1,500 feet east of the intersection with Route 17.  

The permittee will be required to maintain records and report data to verify compliance with the permit conditions and discharge limits.  The application and draft permit are available for public inspection at the NYS Department of Environmental Conservation (DEC), Region 3 New Paltz office.

The applicant proposes to replace the existing Diner's failing septic system with a mounded septic system approximately 170 feet wide by 100 feet long within the 100 foot Adjacent Area of Freshwater Wetland DP-22, Class I.  The  new system will be constructed in phases to allow portions of the existing system to remain in operation during replacement.  Any excess sewage produced during construction will be stored in holding tanks and hauled off-site as needed.  

The applicant has applied for coverage under the State Pollutant Discharge Elimination System (SPDES)General Permit (GP-95-01) to discharge 2,500 gallons of treated sanitary wastewater per day.

This site is located at the intersection of NYS Route 22 and Haviland Hollow Road (southeast corner).

The Department has made a tentative determination to approve this application to modify an existing SPDES permit (SPDES # NY 0248037) to allow the surface discharge of up to 25, 000 gallons of treated sanitary wastewater per day.  The existing SPDES permit authorizes the discharge of up to 6, 675 gallons per day (gpd) from one outfall to the Hudson River.  The proposed modification would accommodate the anticipated increased use of the existing Friary, Youth and Ministries building and the Hamilton Fish Mansion. A draft permit containing proposed effluent limits and monitoring requirements has been prepared by the Department for this discharge.

This project is located on the west side of NYS Route 9D approximately 0.5 mile south of the intersection with Route 403.

The permittee will be required to maintain records and report data to verify compliance with the permit conditions and discharge limits.  The application and draft permit are available for public inspection at the NYS Department of Environmental Conservation (DEC), Region 3 New Paltz office.

The Department has made a tentative determination to approve this application to modify a SPDES permit to allow a subsurface discharge (Outfall 002) of 3,076 gallons per day (gpd) of sanitary wastewater. The modification will discontinue the existing surface discharge (Outfall 001) of the same volume from the  applicant's business establishment, the Mountainside Restaurant and Motel, and reflects construction of a new subsurface wastewater disposal system in order to meet requirements of the NYC Watershed Rules & Regulation (WR & R). There will be no increase in volume of the discharge as a result of the project. The Mountainside Restaurant facility is located in the hamlet of Glenford on the north side of NYS Route 28, west of Maverick Road (County Route 43) in the Town of Hurley, Ulster County. A draft permit is available for inspection and comment at the regional office.

The applicant proposes to stabilize approximately 250 feet of eroding streambank on the Hutchinson River by placing grouted rip-rap and vegetative plantings.  The location is at the Westchester County DPW Hutchinson Pumping Station off Garden Avenue.

         Juda Construction as applied for approval to switch from its current "registration status" to obtain a Part 360 permit in order to continue operating its existing Construction & Demolition (C&D) debris processing facility. The existing 2.7 acre facility processes for reuse approximately 2,000 cubic yards per day of uncontaminated soil, rock, brick and stone from demolition sites.   Juda Construction would continue to operate this facility at this current tonnage and within its current operating hours of 7:00 A.M. to 6:00 P.M. Mondays through Saturdays.

       Juda Construction has also applied for an Air Registration to continue to operate a portable crusher and screening plant, including an 827HP diesel engine.  As part of this application Juda Construction has agreed to "cap-by-rule" which means they have agreed to enforceable conditions in their registration that would require them to stay below 50% of the Title V emission thresholds.
