The Department has made
a tentative determination to approve this application for a new
SPDES permit (SPDES # NY-0268046) to allow the surface discharge of up to 2,850
gallons of treated sanitary wastewater per day from one outfall to an unnamed Tributary
of Shawangunk Kill (Index # H-139-13-9-25, Class B). Construction of the outfall
structure will require a Protection of Waters permit Article 15, Title 5 Stream
Disturbance.
The proposed Wastewater
Treatment Facility will serve a proposed Church, Office
Complex and Day Care Facility. A draft permit containing proposed effluent limits and
monitoring requirements has been prepared by the Department for this discharge. This
project is located on the south side of M & M Road approximately 1,500 feet east of the
intersection with Route 17.
The permittee will be
required to maintain records and report data to verify compliance
with the permit conditions and discharge limits. The application and draft permit are
available for public inspection at the NYS Department of Environmental Conservation
(DEC), Region 3 New Paltz office.

on the west side of NYS Route 9D approximately 0.5 mile south of
the intersection with Route 403.

a SPDES permit to allow a subsurface discharge (Outfall 002) of 3,076 gallons per day
(gpd) of sanitary wastewater. The modification will discontinue the existing surface
discharge (Outfall 001) of the same volume from the applicant's business establishment,
the Mountainside Restaurant and Motel, and reflects construction of a new subsurface
wastewater disposal system in order to meet requirements of the NYC Watershed Rules
& Regulation (WR & R). There will be no increase in volume of the discharge as a result
of the project. The Mountainside Restaurant facility is located in the hamlet of Glenford

Construction as applied for approval to switch from its current "registration
status" to obtain a Part 360 permit in order to continue operating its existing Construction
& Demolition (C&D) debris processing facility. The existing 2.7 acre facility processes for
reuse approximately 2,000 cubic yards per day of uncontaminated soil, rock, brick and
stone from demolition sites. Juda Construction would continue to operate this facility at
this current tonnage and within its current operating hours of 7:00 A.M. to 6:00 P.M.
Mondays through Saturdays.
Juda
Construction has also applied for an Air Registration to continue to operate a
portable crusher and screening plant, including an 827HP diesel engine. As part of this
application Juda Construction has agreed to "cap-by-rule" which means they have
agreed to enforceable conditions in their registration that would require them to stay
below 50% of the Title V emission thresholds.
