The Department has drafted
an Air State Facility Permit pursuant to Article 19 (Air
Pollution Control) of the NYS Environmental Conservation Law (ECL) and Federal
Clean Air Act Amendments and made a tentative determination to approve this
application for Henkel Loctite Corporation's Dexter Electronic Materials facility located
at 211 Franklin Street in the City of Olean. Resins for use in the electronic component
industry are manufactured at the facility. Typical use of the resins is for protection and
insulation of electrical micro-components. The resins are produced in both liquid and
powder form. The manufacturing processes include batch mixing, blending, extruding,
grinding, and compacting. The draft permit limits the emission of any single hazardous
air pollutant (HAP) to 9 tons per year (tpy), total HAPs to 22.5 tpy, and Volatile Organic
Compounds (VOCs) to 45 tpy. By imposition of the this Federally enforceable cap, the
facility is not subject to Title V permitting under 6 NYCRR Part 201-6 and also avoids
the Reasonable Available Control Technology (RACT) requirement for VOCs under 6
NYCRR Part 212.10(a)(2). The application, draft permit, relevant supporting materials,
and regulations are available for review during normal business hours at Region 9 Office
of the NYS Department of Environmental Conservation.

The applicant proposes a
surface discharge of 4500 gpd of treated sanitary wastewater
through a septic tank and sand filter to Willow Creek, a Class C stream, and a subsurface
discharge of untreated sanitary wastewater through a septic tank and leach bed to
groundwater at the Willow Creek Winery, located at Chapin and Center Roads in the
Town of Sheridan. The applicant plans to operate a catering center at the Winery.
The Department has made
a tentative determination to issue a permit for a State Pollutant
Discharge Elimination System permit under Article 17 of the Environmental
Conservation Law. This tentative determination indicates that the discharge regulated
under this statue is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
department approval for or endorsement of the activity for which a permit is sought or for
the overall proposed project.

mining of gravel and material processing with a portable dry-screen that has a maximum capacity of 50
tons per hour, affecting 3.42 acres of land. Of
this acreage, 2.94 acres are proposed to be mined and 0.48 acres are occupied by the haul
road, which is an existing graveled driveway on the applicant's property, shared with the
Town of Westfield. The estimated life of the mine is 10 to 12 years and the reclamation
objective is an improved grape vineyard. The site is approximately 525 feet north of
West Main Road (U.S. Route 20) and 3,000 feet east from Walker Road. The haul road
provides access to West Main Road.

The proposal is for the
ratification and approval of the past actions of the Town of Aurora
in establishing Town of Aurora Water District No. 17 and the taking of a supply of water
in amounts estimated to average 5,400 gallons per day. Water is to be taken from surplus
of the Town of Elma, which in turn is served as a bulk customer from the Erie County
Water Authority. Maximum daily demand is estimated at 10,800 gallons per day. The
new water district will serve a total of eighteen parcels along Stoneybrook Road and
Willardshire Road in the Town of Aurora. The project includes the installation of
approximately 3,350 linear feet of eight inch watermain, fire hydrants and related
appurtenances. Application materials and documents in support of the request for a
