Pursuant to ECL 27-1407 and 1417

The New York State Department of Environmental Conservation (Department) administers the Brownfield Cleanup Program pursuant to ECL 27-1400 et seq. The Brownfield Cleanup Program is designed to encourage the remediation of contaminated properties known as brownfields for reuse and redevelopment. CL Development, LLC has submitted an application, dated December 18, 2003, to participate in the Brownfield Cleanup Program. The application was determined to be complete by the Department on December 23, 2003. The property described in the application is located at 136 & 138 East Genesee Street, in the Village of Baldwinsville. The application proposes that the applicant will conduct remediation activities at the site. The application proposes that the site will be used for commercial purposes.

The Department will receive public comments concerning the application for thirty days, from January 7, 2004 through February 6, 2004. Negative Declaration

Broome County - Broome County, as lead agency, has determined that the proposed Broome County Landfill 6 NYCRR 360 Permit no. 7-0399-00027/00002 Modification – Vertical Expansion will not have a significant adverse environmental impact. The action involves Broome County proposing to modify the existing permit to increase the final approved height of the landfill by approximately 110 feet. This would result in a finished elevation of 1630 feet mean sea level. The proposed height increase will provide approximately 1.5 million cubic yards of additional capacity in Section II and III of the existing landfill before transitioning to Section IV. The proposed modification is estimated to provide an additional 4.6 years of site life. Condition 74 of the Landfill Permit concerns bird hazard to aircraft mitigation. Other permit conditions to be modified include Condition 28: chain link fences and gates required around all sedimentation ponds and Condition 33: quarterly monitoring for BTEX. The Final EIS for the Expansion of Broome County’s Nanticoke Landfill was published in 1984. This project represents a change to that action.
