The Department has made
a tentative determination to approve an application for a
modification of an existing SPDES permit (NY0001856) to discharge approximately 2.5
MGD of treated process wastewater to a tributary of the Oswegatchie River from an
existing outfall (001) at the permittee's paper mill located in the Hamlet of Newton Falls
in St. Lawrence County. The modification also includes the discharge of approximately
30,000 GPD of treated sanitary wastewater and 1.2 MGD of cooling water from two other
existing outfalls (002 & 003) discharging to the Oswegatchie River. The permittee
initially plans on producing 215 tons per day of paper at the site. The draft permit with
conditions is available in the Region 6 NYSDEC office in Watertown, New York.

renew an expired mining permit for the Swartz #1 sand pit, a
7.5 acre mine located on a 322.4 acre parcel owned by the applicant. The site is located
2000' east of VanKennen Road, 6000' southeast of the hamlet of Plumbrook. While there
is no current proposal to expand the present mine boundary, the applicant, through
improved surveying, requests ratification that the actual mine acreage is 13 acres.

expand an existing 24.3 acre topsoil mine (Norfolk Topsoil
Mine) by 12.2 acres, for a new life of mine of 36.5. The mine is on a 123.8 acre parcel
owned by the applicant. The site is located south of CR47, approximately 1.5 miles east
of the intersection of CR47 and State Route 56, approximately 1.5 miles southeast of
Norfolk. Concurrent site reclamation is proposed with open field habitat reestablished.
