The Department has made
a tentative determination to approve this application for a
SPDES permit to discharge a maximum volume of 125,600 gallons per day of treated
sanitary wastewater from a proposed sewage treatment plant into Wappinger Creek [DEC
Water Index No. H-101; Class B(T)]. The proposed plant will be located on the west
side of Overlook Road, approximately 1,000 feet north of the intersection with NYS
Route 55 and will serve the proposed Sleight Farm and Frank Farm residential
subdivisions. The permittee will be required to maintain records and report data to verify
compliance with the SPDES permit conditions and discharge limits. A draft SPDES
permit (SPDES No. NY-0264989) is available for review at the NYSDEC Region 3
office.
Construction of the plant
will require installation of a new 12-inch diameter outfall on the
banks of Wappinger Creek and the permanent filling of less than 0.1 acre of federally
regulated wetlands on the site for access road construction. A stormwater pollution
prevention plan has been prepared for the site pursuant to the SPDES General Permit for
Stormwater Discharges from Construction Activities (GP-02-01).

The Department has made
a tentative determination to approve this application for a
SPDES permit for a previously existing surface discharge from an outfall (No. 001) with
a maximum daily flow of three (3) gallons per day (gpd) at Shaft 13 of the Delaware
Aqueduct located on the northern side of Cross River, Class A(t), near the western
terminus of Cross River Reservoir. Outfall No. 001 reflects a discharge to Cross River of
groundwater inflow and infiltration pumped from three underground sumps: Boiler Room
Sump, Loading Well Sump, and Main Basement Sump. The project involves no new
construction at the existing water supply facilities. Shaft 13 is located on the south side
of NYS Route 35 (Cross River Road), approximately 1500 feet east of NYS Route 22 in
the Town of Bedford, Westchester County. A draft permit is available for inspection and
comment at the regional office.
