6NYCRR Part 40 Notice of Proposed Rule Making

Pursuant to the Environmental Conservation Law, Sections 11-1303 and 13-0339-a, the Department of Environmental Conservation hereby gives notice of the following:

Notice of Proposed Rule Making for 6NYCRR Part 40 relating to marine finfish. This notice will be published in issue 1 of the State Register, dated 1/7/2004.

Conditioned Negative Declaration

Nassau County - The Planning Advisory Board of the Town of Oyster Bay, as lead agency, has determined that the proposed Redevelopment of 145 Stewart Avenue (Garrett Auto Parts Property), Bethpage, NY will not have a significant adverse environmental impact provided specific conditions are met. There will be a 30 day public comment period commencing with the date of this notice. The action involves a property which will be redeveloped for use as a Commerce Bank Facility. All existing structures on the site associated with Garrett Auto Parts will be demolished, the site will be remediated pursuant to NYSDEC requirements, and a new Commerce Bank Building will be constructed, with associated parking, driveways and landscaping. The project is located in the Town of Oyster Bay.

The conditions are:

Issuance of building permit for the construction of the new bank building and areas of on-site pavement shall be contingent upon verification from NYSDEC that excavation and removal of contaminated soils has been completed to that agency’s satisfaction.

Notice Of Acceptance Of Final EIS

Suffolk County - The Planning Board of Smithtown, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Hamlet at St. James #1013. The action involves subdivision approval to construct 167 single-family homes, each lot at least 12,481 square feet, with 12.27 acres to be preserved and operated under the control of a Homeowners Association, with other miscellaneous facilities, to be located on a presently vacant 108.44 acre parcel zoned R-21 CL and B1. The project is located on NYS Route 347 and Moriches Road, St James, Town of Smithtown.
