The Department has made
a tentative determination to approve an application for a
modification of an existing SPDES permit (NY0121142) to discharge to the Oswegatchie
River via a newly constructed outfall at the applicant's dairy and whey plants on Union
Street (State Route 184) in the Village of Heuvelton in St. Lawrence County. An existing
outfall (002) under this permit discharges non-contact cooling water from the whey plant.
A second existing outfall (001) discharging non-contact cooling water from the dairy will
be added to this permit. The SPDES permit (NY0257605) for the dairy's non-contact
cooling water will be deleted. The newly constructed outfall (003) is proposed to
discharge approximately 0.188 MGD of treated process wastewater from an
anaerobic/aerobic treatment plant which is to be built at the site. The applicant operates a
dairy which produces ricotta, mozzarella and provolone cheeses and a whey processing
plant at the site.
The Department has also
made a tentative determination to issue an Article 15 excavation
and fill in navigable waters for the installation of the outfall pipe into the Oswegatchie
River. The draft SPDES permit and Article 15 application are available for review in the
Region 6 NYSDEC office in Watertown, New York.
