ENB Region 1 Completed Applications 12/17/2003

The applicant proposes to subdivide a 8.5 acre parcel into two lots.  Lot No. 1 would measure approximately 7 acres and contain the existing dwelling and accessory structures.  Lot No. 2 would measure approximately 1.5 acres.  It is anticipated that a single family dwelling with accessory structures would be constructed on the new parcel, but that activity is not the subject of this application.  Access to both parcels would be from Briarwood Crossing.

The applicant proposes to operate a transfer station processing up to 13,000 cubic yards per year of non-source separated construction and demolition debris, whole tires and source separated recyclables.  The facility is currently operating under a NYSDEC solid waste registration.  The facility is located at 99 East Jamaica Ave., Village of Valley Stream, Nassau County, NCTM # 37, Block K, lots 31 & 46.

The applicant proposes to operate a transfer station processing up to 620 tons per day of construction and demolition debris, concrete, asphalt, brick, soil, rock and clean wood. The facility is located at 97 East Hawthorne Ave., Village of Valley Stream, Nassau County , NCTM #  Section 37, Block K, Lots 32 & 33

 

The Department has prepared a Draft Permit and has made a tentative determination to approve this application.

The facility operations include: seven (7) permitted storage tanks; six of them are used to store gasoline and one for the storage of ethanol, a truck loading rack that is used to transfer petroleum products from the tanks to the trucks, and a Vapor Recovery Unit that controls the emission of vapors from the loading of gasoline into the storage tanks and trucks.

This modification to the Commander Oil Terminal’s Title V Permit seeks to incorporate the modifications necessary for the facility to comply with New York State requirements to end the use of Methyl Tertiary Butyl Ether (MTBE) as a gasoline additive after January 1, 2004

In accordance with 6NYCRR Parts 621.5(d)(9) and 2016.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.  It is recommended that an appointment be made to confirm the availability of the subject files.  The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date.

DEC will evaluate the application and the comments received on it to determine whether told a public hearing.  A public hearing may be legislative or adjudicatory.  A legislative public hearing is a proceeding which provides an additional opportunity for public comment.  DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists.   If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments.   The applicant and all persons who  have filed comments on the permit will be notified by mail of the public hearing.  Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below.

An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination.  An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist.   A copy of the Department's permit hearing procedures is available upon request or on the Department web site at: http://www.dec.state.ny.us/website/ohms/gudph1.htm

Applicant proposes to construct 92 linear feet of new bulkhead at and below mean high water with (2) 10 foot returns to meet adjacent bulkheads. Action will close off existing boat slip and includes the placement of 50 cubic yards of clean fill and will require the modification of the previously permitted 5'x 40' pier to meet proposed bulkhead. Project is located on Garfield Place, Massapequa.

The applicant proposes to install one (1) 20" x 14" diameter public supply well with the capacity to pump 650 GPM.  The well will be approximately 110' deep and will be located at the Oak Avenue well field, Flanders, Town of Southampton.

Applicant proposes to  to close off landward 20' x 9.25' portion of existing 40' x 9.25' boatslip by constructing 9.25' of new bulkhead, dredging remaining 9.25' x 20' boatslip to -4 MLW and placing resultant spoil as fill. Action will include refacing remaining boatslip and repositioning existing 15' x 20' garage over filled boatslip area.

The Department has made a tentative decision to approve a request to modify the facility's discharge permit to eliminate VOC monitoring requirements for outfall #01B.  This outfall has been below the measured parameters for several years.  In addition, the permit may be modified to allow filtered samples for testing for aluminum at outfall #08.   The facility is located at the Brookhaven National Laboratory site, Upton, Town of Brookhaven, Suffolk County.  A draft permit is available for review at the regional Stony Brook office.    

The applicant proposes to construct a single family dwelling with decks and septic system within the adjacent area of a NYS regulated Freshwater Wetland (#BE-17).  The dwelling is proposed to be located within 62 feet of the freshwater wetland, and the septic system is proposed within 75 feet of the wetland.  The project is located on the northeast corner of Ridge Avenue and Center Street, Fire Island, Town of Brookhaven, SCTM # 0200-985.80-7-14.

The applicant proposes to construct additions and patios to an existing single family dwelling and install a pool with deck.  The entire property is located seaward of the Coastal Erosion Hazard Area Line, and a variance request from the development restrictions of Part 505 has been submitted.  The project is located on the south side of Whaler's Lane, Amagansett, Town of East Hampton, Suffolk County, SCTM# 0300-152-02-14.  

The applicant proposes to construct a 6" diameter well, approximately 170 feet deep, with a pump capacity of 40 gallons per minute,  for the purpose of irrigation of shrubs.   The project is located at Computer Plaza, Islandia, Town of Islip.

Applicant proposes to construct a new sanitary pump station to replace an existing 70 year old station.  The new station will encompass a 40' x 60' area and contain a generator and control building, valve vault and pump station.  Emergency power natural gas generator will also be provided.  The gravity sewer collection system will be extended to the new pump station location.  The project is located on Elton Streeet, Riverhead (SCTM# 109-01-P 11.2). town of Riverhead.
