a tentative determination to approve the application of the
Barrett Paving Materials facility, a crushed stone and asphalt production facility. The
State Facility Permit allows the operation of Emission units 1-PLANT, 2-STONE, and 3-GENST which includes
asphalt production, including waste oil as a fuel; crushing and
screening of stone, including temporary portable operations; diesel generator operation;
and exempt and trivial sources. The facility has capped out of Title V, and NOx RACT.
Permitting requirements by tracking and restricting its facility emissions of PM-10, NOx,
and CO below 95 tons per year.

This permit application
is to apply for an Air State Facility permit for the existing
Burrows Paper Corporation, Lyonsdale Facility. This facility is located in the Town of
Lyonsdale, in Lewis County, along the Moose River.
The mill has one paper machine
that produces an average of 45 tons per day of
lightweight specialty tissue. There are two emission points from the process area of the
paper machine and one emission point from the boiler. The two process emission points
are exhaust fans from the paper machine area. The boiler is 49 mmbtu/hr unit that is
capable of firing natural gas or No. 2 fuel oil.
The facility, in applying
for a State Facility permit, is being capped below major source
thresholds for all pollutants. The facility emissions for the following pollutants are being
capped below major source thresholds: PM, VOCs, NOx, SO2, CO, INDIVIDUAL
HAPS, AND TOTAL HAPS. These caps prevent the source from being subject to Title
V, NOx RACT, PSD, and any NESHAPs. The following individual HAPs are capped to
prevent ambient impacts from exceeding the DAR-1, Short Term Guideline
Concentrations (SGCs), and Annual Guideline Concentrations (AGCs) thresholds include
Formaldehyde, Glycol Ether, Silicon Dioxide, and Quartz. Emissions of HCI, Ethylene
Glycol, and Ethylene Glycol Monoethyl Ether are capped to avoid Title V. The boiler is
subject to the New Source Performance Standards under 40 CFR 60, Subpart Dc.

This Department has received
a request to renew a permit and has drafted an Article 19
(Air Pollution Control) of the Environmental Conservation Law, an Air Title V Facility
Permit, at the facility located at Varflex Corporation, 512 W. Court Street, Rome, NY
13440.
The Department has made
a tentative determination to approve the application of the
Varflex Corp. facility, a manufacture of sleeving primarily used for thermal and/or
electrical insulation of prejacketed conductors. The Title V Facility Permit allows the
operation of Emission units
U-00011, U-00017, U-00021,
U-00027, U-00051, U-00061, U-00071, U-00121, and U-00131, which include the drying and curing operation
of the insulation on braided wire,
and exempt and trivial sources. The emissions associated with the above referenced units
are Volatile Organic Compounds (VOC's). The facility has capped emissions of VOC's
to avoid 6NYCRR Part 228 requirements.
The facility has capped
out of Title V Permitting requirements by tracking and restricting
its emissions of Sulfur Dioxide (SO2) below 100 tons per year.
Persons wishing to inspect
the subject Title V files, including the application with all
relevant supporting materials, the draft permit, and all other materials available to the
DEC (the "permitting authority") that are relevant to this permitting decision should
contact the DEC representative below. It is recommended that an appointment be made
to confirm the availability of the subject files. The DEC will endeavor to make the files
available within 2 business days of contact, during normal business hours (8:30 a.m.
through 4:45 p.m.), unless the requester wishes to inspect the files at a later date.
DEC will evaluate the application
and the comments received on it to determine whether
to hold a public hearing. A public hearing may be legislative or adjudicatory. A
legislative hearing is a proceeding which provides an additional opportunity for public
comment. DEC's determination to hold a legislative public hearing will be based on
whether a significant degree of public interest exists. If a legislative public hearing is to
be held, a Notice of Hearing will be published which will include the time and place of
the hearing and submitting comments. The applicant and all persons who have filed
comments on the permit will be notified by mail of the public hearing. Comments and
requests for a legislative hearing should be in writing and addressed to the Department
representative listed below.
An adjudicatory public hearing
is a trial type proceeding which provides the opportunity
for adjudication on the basis of evidence, including direct testimony and cross
examination. An adjudicatory hearing is held only if substantive and significant issues
relating to any findings or determinations the Department is required to make pursuant to
the Environmental Conservation Law exist. A copy of the Department's permit hearing
procedure is available upon request or on the Department's web site at:

In accordance with 6NYCRR
Part 621.5(d)(9) and 201-6.4(c), the Administrator of the
Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title
V Facility Permit if it is determined not to be in compliance with applicable requirements
of the Clean Air Act or 6NYCRR Part 201. After the public comment period, the
USEPA will be provided a proposed permit and will have an additional 45 day period for
review. If USEPA does not raise any objection, the Department will issue the permit.
