Section 401 - Clean Water Act Water Quality Certification |
| Project is Located: | Wheatfield, Niagara County |
| Project Description: | |
|
As part of residential subdivision
construction in the Wheatfield Lakes Planned Unit
Development, 0.40 acre of Federally jurisdictional wetlands will be unavoidably
impacted. The project will impact 0.37 acre of linear wetland presently located within a
drainageway crossing the 113 acre project site, and indirectly impact an additional 0.03
acre of an off-site wetland. The applicant has applied for a Nationwide Permit from the
U.S. Army Corps of Engineers to authorize wetland impacts associated with the
development, and requires Water Quality Certification pursuant to Section 401 of the
Federal Water Pollution Control Act and 6 NYCRR Part 608.9 of the applicable State
regulations. Three stormwater ponds will ultimately increase the amount of wetlands
present on the project site from 0.45 acre to over 2.4 acres, will increase the overall
aquatic habitat in the form of ponds, will improve the overall water quality in the form of
reduced sedimentation and increased biofiltration, and will address stormwater issues
related to the existing drainageway. The Wheatfield Lakes Planned Unit Development is
located south of Jagow Road and Ferchen Roads, and west of Sy Road.
