The Department has made a tentative determination to issue a modification to the Part 360 permit for the Lindley Industrial Landfill which accepts inert ceramic material. The modification, which requires a variance from Part 360, includes modifying the proposed 24-inch thick barrier protection layer of soil, required for the closure of the facility, to an 18-inch layer. The applicant has effectively demonstrated that the proposed variance will provide the performance required by the regulations and will be protective of the environment. The file is available for review and comment at the NYSDEC Region 8 office in Avon.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
