Notice Of Draft Hazardous Waste Facility Siting Plan, Acceptance Of Supporting Draft Generic EIS, And Associated Public Hearings

The New York State Department of Environmental Conservation (Department) has prepared a draft Hazardous Waste Facility Siting Plan, pursuant to Chapter 618 of the New York Laws of 1987 and Environmental Conservation Law (ECL) 27-1102. The Department, as lead agency, has determined that a generic Environmental Impact Statement (EIS) is necessary and has prepared the draft generic EIS on the New York State Draft Hazardous Waste Facility Siting Plan. Legislative Public Hearings will be held on the draft Hazardous Waste Facility Siting Plan (Siting Plan) and the supporting draft generic EIS.

The Siting Plan is to be used as guidance by any hazardous waste facility siting board reviewing proposals for siting certain new or expanded hazardous waste management facilities within New York State and for Department and other State government agencies to use to assure the availability of sufficient hazardous waste facility capacity. This, in turn, will help avoid potentially significant adverse impacts, such as impacts to air, land, water, or public health due to improper management of hazardous wastes.

The hearing locations are reasonably accessible to the mobility-impaired. Interpreter services can be made available to the hearing-impaired at no charge, upon request to the Department within a reasonable time period prior to the hearings.

All persons, organizations, corporations or government agencies, etc., which may be affected by the proposed Siting Plan are invited to attend the hearings and to submit either written or oral statements. The hearing session will continue until all persons wishing to make statements have been heard. Reasonable time limits may be set for each speaker to afford everyone an opportunity to be heard. Lengthy statements should be submitted in writing and summarized for oral presentation. Written statements received prior to the close of the public comment period and oral statements made at each hearing session will be given equal weight.

Designation Of Critical Environmental Area

St. Lawrence County - The Town of Colton designates the following lands as Critical Environmental Areas. The lands to be so designated shall be all those lands situated in the Town of Colton bounded by Route 52 on the west; Stark Road and the Town of Colton Town Line on the North; Town of Colton Town Line on the East; and Route 3 on the South. The lands represent a significant social cultural, historic and recreation value to the Town of Colton.

Negative Declaration

Herkimer and Lewis Counties - The New York State Department of Environmental Conservation, as lead agency, has determined that the proposed Amendment to the Independence River Wild Forest Unit Management Plan for ADA Consent Decree Projects will not have a significant adverse environmental impact. The action involves amendment to the 1986 Independence River Wild Forest Unit Management Plan. This allows for maintenance of existing facilities and the construction of new facilities to provide recreational opportunities for people with disabilities identified in the Galusha v. DEC Consent Decree. The project is located in the Towns of Watson and Greig and Town of Webb.

Jefferson County - The Town of Ellisburg, as lead agency, has determined that the proposed Town of Ellisburg Water District No. 1 - District Extension will not have a significant adverse environmental impact. The action involves extension of Town of Ellisburg Water District No. 1 to include two additional properties into said district and extend water service to two residences on said properties. Construction of the improvements to serve the extension will take place at the same time and in conjunction with the construction of the water storage and distribution system for the entire recently formed Town of Ellisburg Water District No. 1. The project is located in the Town of Ellisburg Water District No. 1, Town of Ellisburg, County of Jefferson, NY.
