The applicant proposes
to construct a 302 unit apartment and townhouse complex, on
approximately 67 acres, known as "Brookside Meadows" in two phases. The first phase
will include the construction of 12 buildings that consists of 64 apartments and 16 town
houses and the installation of water supply and wastewater piping. These utilities will
require a crossing of Freshwater Wetland SP-53, Class II and its adjacent area, along with
a crossing of the tributary of Great Spring Creek, Index # H-101-12-1, Class B. There
will be eight subsurface sanitary wastewater treatment systems installed on the north side
of the stream with a total estimated flow of 22,810 gallons per day. These subsurface
systems will be taken off-line after the completion of the construction of the proposed
wastewater treatment plant, during the second phase of the project.
The second phase of the
project proposes the construction of 32 buildings that consists of
184 apartments, 36 townhouses, pool building and a wastewater treatment plant to serve
the entire development. The estimated effluent is 65,280 gallons per day of treated,
sanitary wastewater discharged to the Great Spring Creek. The expansion and
reconstruction of an existing farm road through the freshwater wetland and its adjacent
area along with the installation of a bridge to cross the tributary of Great Spring Creek
will be required to provide access and egress between the two phases of this apartment
complex development. Approximately 0.1 acres of wetland and 0.6 acres of State
regulated Adjacent Area are proposed to be filled. Mitigation for this fill will be the
creation of approximately 0.28 acres of freshwater wetland on site. The proposed bridge
will span at least 20 feet to minimize any potential adverse impacts to wildlife.
The Department has made
a tentative determination to issue a permit for a State Pollutant
Discharge Elimination System permit under Article 17 of the Environmental
Conservation Law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
department approval for or endorsement of the activity for which a permit is sought or for
the overall proposed project.
