PROPOSED ESTABLISHMENT OF EMISSION REDUCTION CREDITS
Town of Tonawanda, Erie County - - The Department has received an application for 13.83 tons of Volatile Organic Compounds (VOC) emission reduction credits (ERCs) from the United Refining Company of Warren, Pennsylvania, for its Tonawanda Terminal located at 4545 River Road in the Town of Tonawanda, NY. The Permittee has modified its air permit to no longer dispense gasoline as of May 12, 2000 at this facility. The modification to United Refining’s Tonawanda Terminal air permit is federally enforceable. The Department has made an initial determination to issue 13.83 tons of certified VOC ERCs to United Refining Company in accordance with 6 NYCRR Part 231 "New Source Review In Nonattainment Areas And Ozone Transport Regions". The application and supporting documentation are available for review at the NYSDEC Region 9 office at 270 Michigan Avenue, Buffalo, NY 14203-2999.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than October 10, 2003.

Erie County - The Town Board of the Town of Tonawanda, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Colvin Woods Business Park. A public hearing on the Draft EIS will be held on September 22, 2003 at 8:00 p.m. at the Town of Tonawanda Town Hall, 2919 Delaware Avenue, Kenmore, NY. Written comments on the Draft GEIS will be accepted until October 3, 2003. The action involves I-290 Colvin Associates, LLC – Ciminelli Development Co., Inc. proposes to construct (over a six to ten year period) an approximately 312,000 square foot office/warehouse/flex space complex on approximately 30-acres. The project also includes a new public road and parking on the northernmost portion of Kenney Field, sanitary sewer, water, storm drainage, roadway, electricity, natural gas and other necessary site improvements and infrastructure.
I-290 Colvin Associates, LLC – Ciminelli Development Co., Inc proposes to lease approximately 30 acres of land in the northeastern portion of property owned by the Elmlawn Cemetery. The project site is located adjacent and south of I-290 Youngman Memorial Highway with proposed access to Colvin Boulevard. The project is located at 3939 Delaware Avenue, Town of Tonawanda.
