The applicant proposes relocate
a motor cross track facility from 3500 Harloff Road 75
feet to the East on Harloff Road. As part of the proposed relocation the applicant
proposes to construct two ponds located on the southern edge of a NYS regulated wetland
(OK-23) along a fallow field. One pond will be approximately 10,000 square feet in
surface area, twelve feet deep and will result in about 1,770 cubic yards excavated from
the proposed pond site. The second pond will be approximately 17,100 square feet in
surface area, twelve feet deep and will result in about 3,125 cubic yards excavated from
the proposed pond site. The soil removed from the construction of the ponds will be used
onsite for facilities associated with the motor cross track, outside the wetland and buffer
areas. All disturbed areas will be seeded with a grass mixture.Use of the pond will be
mainly watering the remaining area to be maintained as grassland.

The Department has received
and reviewed an application for the modification of the Part
360 Solid Waste Management Permit for the Steuben County - New Bath Landfill for the
following modifications only: on-site mining for cover material, incorporation of the
description of the landfill closure site into the permit and to specify that the closure site
stopped accepting waste on or about September 30, 2002. The on-site mining will be
undertaken in accordance with the previously submitted Mined Land Use Plan for the
proposed lateral expansion of the Steuben County - New Bath Landfill. Public notice has
been issued for the proposed lateral expansion during the week of August 25, 2003. This
facility will remain in compliance with the Part 360 Solid Waste Management regulations
with the proposed modifications. The State Environmental Quality Review process was
completed on this site as part of the review of the application for the proposed lateral
expansion of the landfill, for which a separate public notice was issued. No additional
environmental impacts are expected as a result of these modifications. The Department
has made a tentative determination to approve these modifications and is seeking
comments on the proposed modifications prior to a final decision on permit issuance.

average 328,750 GPD by connecting existing Industrial Park and Morningside Heights
water systems. The project includes the installation of 19,800 LF of 14" water main and
appurtenances to serve the Erwin Industrial Park and both public and private sector
expansion along a section of Route 417. The file is available for review and comment at
