The applicant proposes an existing discharge of 6.1 million gallons per day of
treated sanitary wastewater to the Mohawk River from a secondary treatment
plant at the applicant’s facility located at 106 West Main Street Mohawk, New
York. The permit will be modified to include:
1) an outfall that has been used as a high water discharge point throughout the
history of the Herkimer County Sewer District (HCSD) Wastewater Treatment
Facility. This outfall is now listed as Outfall 002;
2) another outfall that was designated as a treatment plant effluent discharge
during high waters. This outfall is now listed as Outfall 003. According to a
June 26, 2002 letter from the permittee, the second outfall could be used if
normal power fails and emergency generator also fails. As a result, any
discharge from Outfall 003 is being categorized as a Type 1 Sanitary Sewer
Overflow (SSO) according to the DEC’s draft Compliance and Enforcement
Response Guide (CERG).
The department has made a tentative determination to issue
a permit for a
State Pollutant Discharge Elimination System permit under Article 17 of the
Environmental Conservation Law. This tentative determination indicates that a
discharge regulated under this statute is considered to satisfy regulatory
standards for permit issuance, based on information available to the Department
at this time. As a tentative determination, the Department seeks comments on
the proposed regulated activity prior to making a final decision on permit
issuance. As such, this tentative determination does not signify department
approval for or endorsement of the activity for which a permit is sought or for the
overall proposed project.

The applicant proposes to
replace an existing culvert in Toothaker Creek with a 60' long x
63" x 87" CMP culvert and raise Fullerville Road 2' for a distance of 500' near the
intersection of Fullerville Road and Kansas Road, approximately 2.5 miles northwest of
the hamlet of Pitcairn. The new roadway toe of slope encroaches upon regulated
freshwater wetland H-24, a 30 acre Class II wooded and shrub wetland.
