The Department has made
a tentative determination to approve this application for a new
permit for a discharge of varying amounts of stormwater to a natural drainage way that
ultimately discharges to Black Creek, a class "C" water body. This project involves
enlarging existing retention ponds to increase their retention capacity and further trap and
reduce the amount of sediments moving off site. Excavated materials from the retention
basins as well as from cleaning drainage swales will be disposed of on site.
Approximately 250 LF of drainage swale considered to be jurisdictional waters of the US
ACOE would be filled as a result of this project. The draft SPDES permit (NY 0268305)
is availabe for review.
