The applicant proposes to
construct a 61 lot subdivision on a 47 acre property, called
Wood Harbor Estates, which is located between Bay Road (County Rd. 16) and Maple
Drive in the Town of Webster, Monroe County. The entrance on east side of Bay Road is
located 510 feet north of the intersection of Bay Road and Wood Meadow Way. The
project will disturb approx. 0.67 acres of the 3.02 acres of federal wetlands located on the
site, most of which are associated with three Class C streams whose channels bisect the
subdivision. The streams are tributaries of Shipbuilders Creek. The project requires an
individual permit from the US Army Corps of Engineers pursuant to Section 404 of the
federal Clean Water Act. The applicant proposes to create approximately 1.18 acres of
seasonally flooded forested wetlands as mitigation for the federal wetlands disturbed by
the project.

The applicant proposes to
construct a 2,868 square foot two story retail building on Rt. 96
within the 100 ft. adjacent area of NY State Freshwater Wetland VT-2(II). Alternatives
have been explored to minimize the intrusion within the adjacent area. A wetland
mitigation plan has been conceptually approved by Department staff. This plan would
involve excavation of an existing pond at the Lehigh Crossing Park wetland area. The
pond will be modified to improve water depth and habitat diversity for the benefit of
wetland flora / fauna and the public. The project is located northeast of Pittsford-Victor
Rd. and the Lehigh Valley Railroad in the Town of Victor.
