Project Description:
This Department has received a request to issue a permit and has drafted an Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air State Facility Permit, at the facility located at the East Martinsburg Pit, Town of Martinsburg, Lewis County, New York.  This existing facility is engaged in mining and processing of nonmetallic minerals.  The Standard Industrial Classification representative of this facility is 1422, Crushed and Broken Limestone.

The facility consists of two crushers, two screens, conveyors, and a diesel powered generator.

Facility Oxides of Nitrogen (NOx) emissions are capped below Title V and Major Source thresholds.  

The facility is subject to New Source Performance Standard 40 CFR 60 Subpart 000, Standards of Performance for Nonmetallic Mineral Processing Plants; 6NYCRR Part 225, Fuel Composition and Use - Sulfur Limitations; and 6NYCRR Part 227, Stationary Combustion Installations.

The draft permit with conditions is available for review in the Region 6 NYSDEC office in Watertown, NY.
State Environmental Quality Review (SEQR) Determination:
Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency:
None Designated
State Historic Preservation Act (SHPA) Determination:
The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
