NYPA has filed an application for a federal operating permit under Title V of the Clean Air Act Amendments of 1990 for its existing facility at the above location.   The plant consists of two GE LM6000 natural gas fired combustion turbines which generate 79.9 megawatts. The Department has determined the application is complete and has prepared a draft permit for public review and comment.  

In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The Department will hold a legislative public hearing on the application and draft permit. A legislative public hearing is a proceeding which provides an opportunity for public comment.

A Notice of Complete Application for this application that was posted in the 7/16/03 ENB incorrectly identified the deadline by which comments must be received by the Department.  The correct date is September 26, 2003.

The Department has made a tentative determination to approve this application for a renewal and modification of a permit for an existing discharge of up to 1.5 million gallons per day of treated  wastewater into the East River (Class I) from a chemical treatment plant at the applicant’s facility located at the Northwest end of Roosevelt Island where the applicant is constructing City Water Tunnel #3.  A draft permit is available for inspection and comment at the regional office.

The applicant proposes to install a vinyl liner pool and whirlpool spa including the installation of an interlocking block retaining wall. A four foot wide planting strip is proposed to be established between the pool area and the lake. The applicant also proposes to construct a 2 story 14 foot by 20 foot addition in on the south side of the existing house. The project site is located within the adjacent area of NYSDEC regulated Class II Freshwater Wetland NA-4 (Brady's Pond), 124 Overlook Terrace, Staten Island, Block 3060 - Lot 14.
