a tentative determination to approve a State Pollutant
Discharge Elimination System permit under Article 17 of the Environmental
Conservation Law for the removal of iron & manganese from an existing
recharge/collection basin with subsequent discharge to groundwater. This proposed
activity is located at the SCWA Tower Street Wellfield and Pump Station on the east side
of StonyBrook Road, at Pond Path in Lake Grove, Town of Brookhaven, Sufflok County.

This tentative determination
indicates that the discharge regulated under this statute is
considered to satisfy regulator standards for permit issuance based on the information
available to the Department at this time. As a tentative determination, the Department
seeks comments on the proposed regulated activity prior to making a final decision on
permit issuance. As such, this tentative determination does ot signify Department
approval for or endorsement of the activity for which a permit is sought or for the overall

NYPA has filed an application
for a federal operating permit under Title V of the Clean
Air Act Amendments of 1990 for its existing facility at the above location. The plant
consists of one GE LM6000 natural gas fired combustion turbines which generate 44
megawatts. The Department has determined the application is complete and has prepared
a draft permit for public review and comment.
In accordance with 6NYCRR
Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the
United States Environmental Protection Agency (USEPA) has the authority to bar
issuance of any Title V Facility Permit if it is determined not to be in compliance with
applicable requirements of the Clean Air Act or 6NYCRR Part 201.
The Department will hold
a legislative public hearing on the application and draft permit.
A legislative public hearing is a proceeding which provides an opportunity for public
comment.
The Department is making
the application, supporting documentation and draft permit

The Department has
drafted a permit pursuant to Article 19 (Air Pollution Control) of the NYS
Environmental Conservation Law (ECL) and made a tentative determination to approve this
application for the applicant’s existing asphalt paving process facility. The facility operates a
rotating drum where the asphalt aggregate is dried and mixed with asphalt oil cement. The
asphalt mix produced in the process is routed to a silo for storage and distribution, whereas the
gases and particulate matter produced in the drum are routed through a baghouse for particulate
removal and discharged into the atmosphere through a stack or emission point #1 of the facility.
The facility which is located at 67240 Route 25, Greenport NY is subject to 6NYCRR Part 225-1.2 (Fuel
Composition and Use-Sulfur Limitations), 6NYCRR Part 227-1.3 (Stationary
Combustion Installations-Opacity Limitation), and 40CFR Part 60, Subpart I (Standards of
Performance for Hot Mix Asphalt Facilities). The Permit will cap the emissions of Volatile
Organic Compounds and Nitrogen Oxides by limiting the asphalt mix production to 150,000 tons
per year and by operating the facility with the baseline operating parameters as determined from
emissions testing.
