The Technical Advisory Committee of the Watershed Protection and Partnership Council (WPPC) will meet on Thursday, July 10, 2003 at 10:00 a.m., at the offices of the Empire State Development Corporation, 33 Airport Center Drive, Newburgh, NY.
The Executive Committee of the Watershed Protection and Partnership Council has asked the Technical Advisory Committee to review the interim Phase II Nonpoint Source TMDL Implementation Report (Report) prepared by the New York State Department of Environmental Conservation (DEC), and to make recommendations to DEC on how to finalize the Report.
The New York State Department of Environmental Conservation (Department) has prepared a final Program Policy entitled "Use of Enforcement Discretion - Corrective Action Management Unit Rule Amendments," #DSH-HW-03-18. This final Program Policy takes effect 30 days from the date of this ENB notice.
This final Program Policy provides for the use of enforcement discretion allowing the Department to administer and enforce two provisions of the amendments to the RCRA Corrective Action Management Unit (CAMU) rule promulgated by USEPA on January 22, 2002 in a manner consistent with the requirements of that rule, as amended. This rule applies only to "remediation waste" and does not apply to "as generated" waste from ongoing industrial operations at a site. These provisions (1) allow CAMU-eligible waste to be disposed of off-site in a permitted hazardous waste landfill provided that any "principal hazardous constituents," or "PHCs," in the waste meet environmentally protective treatment standards established through 40 CFR 264.552; and (2) allow limited treatment consisting of physical operations such as blending, mixing and sizing of remediation wastes in "staging piles." CAMU- eligible wastes are defined at 40 CFR 264.552(a)(1).
A draft of this policy was public noticed in the May 14, 2003 edition of the Environmental Notice Bulletin. No comments were received during or after the public comment period, and the Program Policy being issued today contains no changes from the draft version.

Pursuant to the provisions of Environmental Conservation Law, Sections 1-0101, 3-0301, 19-0103, 19-0105, 19-0301, 19-0303, and 19-0305, the Department of Environmental Conservation hereby gives notice of the following:
Adoption of regulations for the addition of 6 NYCRR Part 228, Surface Coating Processes, and the amendment of Part 200, General Provisions. This adoption was filed with the NYS Department of State on June 23, 2003 to be effective July 23, 2003.
The purpose of this rulemaking is to reduce emissions of volatile organic compounds from surface coating processes to the atmosphere that lead to the formation of ozone.
