ENB Region 6 Completed Applications 07/09/2003

The applicant proposes to repair a 10' section of an 8' high x 120' long earthen and timber crib dam located approximately two miles southeast of the hamlet of Jordanville, 2000' south of Blatchley Road and Mixter Road intersection and 2000' west of Mixter Road. The site abuts the downstream limits of regulated freshwater wetland JV-14, a 29 acre Class III deciduous wetland, prediminately wet meadow pasture within the pond boundary limits.  The applicant also proposes to widen the dam from 10' to 20' wide, suitable for crossing with farm equipment.  The resulting pond will be approximately 100' wide x 300' long x 8' deep.  

The applicant proposes to construct a 130 foot long berm along the banks of Sconondoa Creek, a standards C(T) stream, to prevent flooding of their State Pollutant Discharge Elimination System outfall. The berm will also be located in Freshwater Wetland V-5, a class II, 66 acre wetland. The project is located north of NYS Route 5 and between Williams Street and Sconondoa Road.

This Department has received a request to issue a permit and has drafted an Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air State Facility Permit, at the facility located at Mohawk Valley Psychiatric Center, 1400 Noyes at York, Utica, NY  13502.

The Department has made a tentative determination to approve the application of the Mohawk Valley Psychiatric Center facility a psychiatric hospital.  The State Facility Permit allows the operation of Emission units U-00001 and U-G0001, which includes combustion sources, and an electric generator that will be used for utility-sponsored peak-shaving program.  The facility has capped out of Title V, PSD, NSR, and NOx Ract Permitting requirements by tracking and restricting its facility emissions of Oxides of Nitrogen (NOx) below 100 tons per year and tracking and restricting its emissions from emission unit U-00001 of NOx below 39 tons per year.

The draft permit with conditions is available for review in the Region 6 NYS DEC office in Watertown, NY.

The applicant proposes to construct an access road to a residential construction site through Freshwater Wetland CE-58, a class III, 86 acre wetland. The road through the wetland will be 75 feet long and 13 feet wide for a total wetland fill of 975 square feet. There will be 200 additional linear feet of road in the adjacent area. All residential construction will outside the adjacent area. The project is located on the north side of Powell Road between Deely and Kimball Roads.

The applicant proposes to mine 5 acres of sand and gravel from a 26.4 acre life of mine located on a 189 acre parcel owned by the applicant.  The site is approximately 2500' North of the intersection of Braddy Road and NYS Route 345 and 2000' East of Braddy Road, approximately 3.5 miles northeast of the hamlet of Madrid.  In addition, a roadway constructed across 2000' of freshwater wetland WT-15, a 136 acre Class IV wetland would be modified to improve water flow through the wetland.

The applicant proposes a Vegetative Management Program for weed control along the CSX railroad transportation system in NYS DEC Region 6.  The herbicides proposed for treatment of the railroad balast and berm area (24' total width) are Roundup, 24D and Oust.  Application will be in accordance to product label instructions, at minimum effective rates and by licensed commercial applicators.  The transportation system passes through and adjacent to State regulated freshwater wetlands.
