ENB Region 3 Completed Applications 07/09/2003

The applicant proposes to place fill encroaching upon the 100-foot adjacent area of Freshwater Wetland HP-1 by approximately 13 feet, surrounding a proposed septic system. Work is in conjunction with new house construction located at lot #12 on the east side of Nichris Lane (cul-de-sac), north of Mills Cross Road.

The applicant proposes to dredge a total of approximately 13,000 cubic yards of sediments from the Village's Lower (10,550 cubic yards) and Middle (2,400 cubic yards) water supply reservoirs [DEC Index Nos. H-139-13-61-9-20-P683 and -P684; Class AA(TS)].  The reservoirs are located generally east of Pelton Road, approximately 0.5 mile north of the intersection with Black Rock Road.  Semi-volatile organic compounds have been detected in the sediments and portions of the contaminated material will require disposal at an authorized solid waste landfill.  The remainder is proposed for on-site upland disposal near the Village's Upper reservoir, contingent on DEC approval.

The applicant has applied for a permit to rehabilitate and expand an existing wastewater treatment facility from 18,300 to 30,000 gallons per day of treated, sanitary wastewater discharge to an unnamed tributary to Ruddick Pond, a Class B(t) waterbody from a tertiary treatment plant at the applicant's facility located at Moonlight Cottages, 60 Rubin Road, Monticello.  

The applicant is rehabilitating and increasing the capacity of the plant to include a provision for future congregation size increase.  The water quality standards will be maintained through plant design necessary to achieve these standards.

The department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law.  This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time.  As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.  As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.
