The applicant proposes to
add 17.5 acres to the 35 acre Kinley Sand and Gravel mine, for
the purpose of overburden storage and disposal of unmarketable mined material. No
other changes to the mine plan and reclamation objective (wildlife habitat) are proposed.
The mine is located south of Lower Birch Run Road, approximately 0.5 mile west of
Upper Birch Run Road intersection. The expansion area is adjacent to the current south
and west mine limits.

The applicant proposes to
mine sand and gravel with material processing by a portable
dry-screen that has a capacity of less than 150 tons per hour, on 4.0 acres (including the
haul road) out of an 82 acre parcel of land. The haul road is an existing farm road that
will provide access to John Darling Road via Grover Road. The estimated life of the
mine is 5 years and the reclamation objective is agriculture and recreation. The site is
north of New York State Route 241, approximately 1,300 feet west of John Darling Road.

The applicant proposes to
remove and dispose of existing concrete rubble on the
shoreline and construct a sheet pile wall approximately three feet tall and 245 linear feet
in length along 4 contiguous properties to provide erosion protection from the Niagara
River. The wall will not encroach into the river. It will be connected to pilings and tied
back with cables to dead men and backfilled with rock and soil. The Bach, DeLabio,
Helwig and Kunkel properties are located at 42, 44, 50 and 60 Sunset Drive, which are
located off of River Road (NYS Route 266), approximately 4000 feet west of the line
with the City of North Tonawanda.
