The Department has prepared
a draft permit and has made a tentative determination to
approve this application. The existing facility operates one internal combustion engine
with a capacity of 2,370 KW with a selective catalytic reduction unit as emission control
which burns natural gas and #2 fuel oil, and three identical boilers with heat input of 29.3
mmBTU/hr each firing natural gas and #2 fuel oil. The facility proposes to cap their NOx
emissions to below 25 tons per year and is subject to the provisions of 6 NYCRR Part
201-7.2. Persons wishing to inspect the subject Title V files, including the application
with all relevant supporting materials, the draft permit, and all other materials available to
the DEC (the "permitting authority") that are relevant to this permitting decision should
contact the DEC representative listed below. It is recommended that an appointment be
made to confirm the availability of the subject files. The DEC will endeavor to make the
files available within two business days of contact, during normal business hours (8:30
am through 4:45 pm), unless the requestor wishes to inspect the files at a later date. A
public hearing under 6 NYCRR 621.7(c) may be held if a significant degree of public
interest exists.

construct a medical facility including a second floor apartment
within the adjacent area of NYSDEC regulated Class I Freshwater Wetland AR-33
(Lemon Creek - A). A 20 foot by 42 foot area at the rear of the property is a deed
restricted area of no disturbance as required by NYSDEC Permit 2-6405-00259/00001
issued on February 6, 2002 for the construction of a two-family house on the subject
property. The applicant now proposes to modify the existing permit and construct a
medical building instead of the previously permitted two-family house. The project site is
located on Sequine Avenue, Staten Island, Block 6699 - Lots 14 & 15.
