The applicant has proposed
a 6 kilometer reconstruction of NYS Route 5 through the
Town and City of Batavia which includes city drainage improvements. Four existing
drainage culverts which flow to Tonowanda Creek (Class C, Navigable, Flood Control
Project) as part of the storm sewer system, are to be replaced with larger culverts. One
~100 meter section of Tonowanda Creek is to be filled on the outside bank and cut on the
inside in order to flatten, and therefore stabilize, the outside bank slope. The application
is available for public review and comment at the NYS DEC Regional Office.

The New York State Department
of Environmental Conservation (NYSDEC) has
reviewed the Corrective Measures Study for ATOFINA Chemicals, Inc. and has made a
tentative selection of a final remedy to address site contamination at the ATOFINA
Chemicals, Inc.(ATOFINA) facility. The Statement of Basis for the tentatively selected
remedy is available for public review and comment until July 28, 2003. The NYSDEC
will hold a public availability session on June 17, 2003 at the York Town Hall from 7:00
pm.- 9:00 p.m., to provide the public with additional information about this action.
PROJECT SUMMARY
The ATOFINA Geneseo Facility
is located in the Town of York, Livingston County, New
York. ATOFINA is located within the flood plain of the Genesee River, which forms the
site’s northern boundary. Agricultural and undeveloped land form the east and west
boundary and a residential area is located to the southwest. The ATOFINA property
consists of approximately 300 acres of land located off NYS Route 63. Approximately
75 acres of the 300 acre property are used for material processing. The facility began
operations in 1953. Primary products manufactured at the facility are organic peroxides
which serve as feed materials for the plastics industry. Since 1988, ATOFINA has
conducted many investigations of the facility to locate and characterize potential impacts
related to their operations. In 2002, ATOFINA completed a corrective measures study
(CMS) evaluating remedial alternatives for the site. In addition to evaluating possible
corrective measures for individual Solid Waste Management Units, the CMS included an
evaluation of site-wide soils, groundwater and surface water. The CMS also contains an
“Ecological Assessment/Fish and Wildlife Impact analysis” and a “Human Health Risk
Assessment”.
TENTATIVE DETERMINATION
Based on the results of
the CMS, the Department has tentatively selected the remedy
described below:
Selective Waste Removal at the East Landfill Area
Containment/Closure/Stabilization
with soil cover system for the Building 35
Surface Impoundment.
Closure
with selective removal of fill material for the former Container storage area
These actions constitute
the proposed final corrective action remedy for this
investigation area.
Pursuant to Part 617 of
the New York State regulations for Article 8 [the State
Environmental Quality Review Act (SEQR)], NYSDEC has determined that the proposed
action, described above, is an unlisted action and will not have a significant effect on the
environment. A Negative Declaration is on file for this action.

HOW TO PROVIDE YOUR COMMENTS
All comments will be considered
in making the final decision concerning selection of the
remedy. A response to any comments submitted will be issued which will identify any
changes to the proposed remedy and will describe and respond to the issues raised in
writing or at the availability session. A notice of the decision will be sent to each person
who submits written comments or who requests such notice. Written comments about
this action must be sent to the above-listed contact person at the NYSDEC Region 8
Office. A public hearing will be scheduled if warranted based on comments received.

The overall project involves
the reconstruction of approximately 5 miles of Jefferson
Road (NYS Route 252),within the Towns of Chili, Henrietta, Brighton in Monroe
County, from 1300 feet west of the Genesee River to 300 feet east of Edgewood
Avenue. In addition to total reconstruction of the roadway, the project will include
construction of bike space, new sidewalks, additional turning lanes, additional through
travel lanes, and the replacement of the Jefferson Road Bridge over the Genesee River
with a new wider bridge. To increase maneuvering area for vehicles at major intersections
near the Genesee River Bridge, portions of Scottsville Road (NYS Route 383) and East
River Road will be reconstructed with new alignments and the NYS Route 383 bridge
over Black Creek will be removed and replaced. The project will result in unavoidable
loss or alteration of 1.78 acres of combined Federal and State Wetlands, of which 0.94
acres are State Wetlands, and 19.2 acres of State Wetland adjacent area. To compensate
for the wetland losses, that could not be avoided or further minimized, DOT has proposed
the following mitigation within the project corridor: (1) In Phase I of the project, 1.5 acres
of emergent marsh and wet meadow will be created adjacent to the Genesee River and (2)
in Phase II of the project, 0.3 acres of stream restoration will be undertaken.
