Brief Project Description: The former Dowell Facility is a fenced, vacant, site of approximately 3.5 acres, located at 3311 Walden Avenue in the Village of Depew, New York. The site consists of three separate buildings, an office building, a maintenance building and a former chemical storage warehouse. The surrounding land use is mixed with industrial to the west, commercial to the east, a former railroad siding to the south and residential properties are north, across Walden Avenue. Past activities at the site included servicing industrial facilities and limited oil-field related projects. Various industrial cleaning and oil field chemicals were stored for transfer into tank trucks for use at job sites.
Areas of concern are soils northeast of the former chemical storage building and a demolished acid plant, soils in the northwest corner of the former acid plant, soils and sediments within and east of the former maintenance shop. The soils have sustained contamination from various volatile organic compounds (VOCs), such as, 1,1,1-TCA, 1,1-DCA, TCE and PCE in the range of 0.44 to 69 mg/kg (ppm).
Shallow groundwater quality has been compromised by VOCs in the range of 6 ug/l to 50,000 ug/l( ppb) above the NYSDEC Class GA standard of 5 ug/l. Contemplated future use of the property is industria/commercial.
A Remedial Action Work Plan (RAWP) has been submitted for public comment under the Voluntary Cleanup Program The RAWP details actions necessary to mitigate environmental concerns at the site. The RAWP includes; asbestos abatement within building structures, complete demolition of the former maintenance shop and the former chemical storage building (including floor slabs and foundations), removal and disposal of contaminated soils from impacted areas, installation of an additional monitoring well and continued groundwater monitoring and possible deed restrictions.

Project Description: The Department has received a notice of closure from the permittee to permanently close the Dinaire, LLC facility located at 601 Ohio Street, Buffalo, NY.
The Permittee has surrendered the existing State air permits to operate the emission sources located at this facility. Additionally, the permittee, Dinaire Corporation is proposing the establishment of certified Volatile Organic Compounds (VOCís) emission reduction credits (ERCs) for the emission reductions resulting from the permanent shutdown of the facility.
Dinaire, LLC is proposing to establish 34.75 tons of certified ERC's in accordance with 6 NYCRR Part 231 "New Source Review In Nonattainment Areas And Ozone Transport Regions". The application and supporting documentation are available for review at the NYSDEC Region 9 office at 270 Michigan Avenue, Buffalo, NY 14203-2999. Comments will be received for a period of 30 days from the date of this notice.
State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated.
State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management: This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment: Comments on this project must be submitted in writing to the Contact Person no later than July 7, 2003.
