The applicant proposes
construction of a a private residence and a four-bedroom bed and
breakfast, within the 100' adjacent area (an area previously filled under DEC permit) of
freshwater Wetland RP-3, and adjacent to Lake Champlain, Point Au Fer Road at Kings Bay.
The project includes installation of a domestic water supply line, from Lake Champlain, and
installation of an advanced wastewater treatment system, with a design flow discharge of 975
gallons per day of treated domestic wastewater to Lake Champlain, a Class A waterbody. The
Department has made a tentative determination to issue the above-referenced permits, including
the State Pollutant Discharge Elimination System. This tentative determination indicates that
the
discharge regulated under Article 17 of the Environmental Conservation Law is considered to
satisfy regulatory standards for permit issuance, based on information available to the
Department at this time. As a tentative determination, the Depratment seeks comments on the
proposed regulated activities prior to making a final decision on permit issuance. As such, this
tentative determination does not signify Department approval for or endorsement of the activity
for which a permit is sought or for the overall proposed project. Refer to this application by

The applicant proposes an
expansion of a an existing gravel mine, located on the north
side of Macadam Road, approximately 1.4 miles west of the Macadam Road and Ridge
Road intersection, in the Town of Chazy. The expansion will increase the Life of Mine
area to a total of 42 acres, part of a 53.3 acre parcel owned by the Town of Champlain.
Twenty new acres will be affected, and the mining opeartions are expected to run for five
years, with gravel being removed as needed for Town projects. There will be no onsite
processing. The site will undergo concurrent and final reclamation, with no more than
three acres unreclaimed at one time. Final reclamation will consist of establishing stable,
grassed slopes and allowing woody vegetation to establish naturally.

expand a previously approved 59.9 acre Life of Mine area for a
wollastonite quarry (mineral extraction) by an additional 29.9 acres, for a total Life of
Mine of 89.8 acres. No changes in blasting or processing methods will occur as a result
of this expansion. A 0.79 acre portion of wetland will be impacted
by the proposal,
which includes mitigation by the creation of 3.6 acres of wetland area at the applicant's
Oak Hill property. The project is located on Seventy Road in the Town of Lewis, Essex
County. The project also requires a permit from the Adirondack Park Agency (APA) in
accordance with Section 809 of the APA Act and 9 NYCRR Part 578 (APA #99-91). (For

The Department has drafted
and recommends approval of an Article 19, Air State
Facility permit for all emission sources associated with aggregate processing and asphalt
operations at the Lewis aggregate plant. Emission potential to emit has been capped
below the Title V permit requirements and NOx RACT thresholds through limits on
production capacity and hours of operation. This facility wide permit replaces previously
issued individual emission point permits. This permit also includes 40CFR 60 Subpart A
and OOO (New Source Performance Standards) requirements for the equipment
associated with aggregate production. In addition this facility is also subject to 6NYCRR
Parts 200, 201, 202, 211,212,215,227 and Subpart 225-1. The draft permit is available for
