The
applicant proposes a modification of its existing SPDES Permit No. NY-0126519
and the Department has prepared a modified Draft Permit. In addition to the school’s
existing discharge from four outfalls of 16,500 gallons per day (GPD) of treated sanitary
wastewater discharge to groundwaters, the draft permit would include Outfall 005, a
proposed 960 GPD treated floor drain discharge at the school bus garage to the Class C
(T) Tributary #1 (Gallup Stream) of Brokenstraw Creek at the applicant's facility located
on the north side of Main Street (NY Rt. 474) at Mohawk Street.
The
Department has made a tentative determination to issue a permit for a State
Pollutant Discharge Elimination System permit under Article 17 of the Environmental
Conservation law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
department approval for or endorsement of the activity for which a permit is sought or for
the overall proposed project.

The Department has made
a tentative determination to approve a modification to the
existing Air State Facility Permit and has prepared a draft permit for the plant on Wasson
Street which is a commercial packaging printing facility that prints on plastic film for
products such as bread bags. The modification request is for the removal of three existing
presses and the installation of two new presses and a catalytic oxidizer. The company is
subject to 6NYCRR Part 201-5 due to the proposed modification of an existing emission
source. Printing operations are subject to 6NYCRR Part 231-2 and to Reasonably
Available Control Technology provisions in 6NYCRR Part 234. The annual Volatile
Organic Compound (VOC) emission rate will not be increased from the initial permit
which established a federally enforceable 15 ton per year VOC emission limit. The
application, draft permit, relevant supporting materials and regulations are available for
review at the Department's Region 9 Office, Buffalo, during normal working hours.

The applicant proposes a
streambank protection project located on Tonawanda Creek at
Tonawanda Creek Road North near Minnick Road in the Town of Lockport. The project
consists of the removal and subsequent reconstruction of 120 foot of the road, installation
of a 4 foot diameter drainage culvert pipe and construction of a 230 foot long steel sheet
pile retaining wall, with associated granular fill of 400 tons of crushed stone and a rock
riprap revetment toe consisting of 800 tons of 18-inch stone to protect the streambank
from erosion.

install year round public water and sanitary sewers on Sunset
Island. The watermain and sewer forcemain will be installed by directional drilling under
Tuscarora Bay and will be connected to the existing systems. The 6-inch diameter water
supply line will be installed under the bay in the vicinity of the Crow's Nest Restaurant
and the 4-inch diameter low pressure sewer will be connected to the Village of Wilson
Waste Water Treatment Plant by a connection to be drilled under the bay at the harbor
entrance.
