The Department has made
a tentative determination to approve a modification to the
existing permit (NY0204781) and has prepared a draft permit which is available for
review and comment at the regional office. The permit would allow the surface discharge
of 2,400 gallons per day of treated sanitary waste to the unnamed tributary #2 of Oil
Creek (identified as PA 53-54-11-2). Tributary #2 has a class and standard of "A". A new
treatment system consisting of a septic tank and sand filter with disinfection would
replace the existing failing treatment system. The facility is located approximately 500
feet north of Route 446 on the east side of Union Hill Road.

This application is for
the installation of a water distribution system to serve the newly
created Town of Portland Water District No. 5, and the taking of a supply of water in
amounts estimated to average 27,360 gallons per day. Water is to be obtained from
surplus of the Village of Brocton water supply. Maximum daily demand is estimated at
68,400 gallons per day. The new water district will initially serve 122 residential lots, 3
commercial properties and Lake Erie State Park in the town. The 20-year projected
average daily demand, estimated at 33,000 gallons per day, includes anticipated growth.
The proposed system includes intstallation of approximately 55,000 linear feet of
watermain and related appurtenances.

The proposal is for the
construction of a 28 foot high earth dam that would create a 1.88
acre private pond, designed to impound 9.87 acre feet of water at the permanent pool
elevation. The service and auxiliary spillways will both discharge to an existing stream.
As part of the proposal, about 850 linear feet of unprotected, seasonal stream would be
relocated away from the base of the dam. That stream’s flows will be carried via a newly
constructed parabolic channel which is designed to handle flows from a 100 year storm
event. The dam’s discharge flow is also sized for that event. The project is located at
3679 East Blood Road, about 1300 feet southeast of the intersection of East Blood and
Liberia Roads.

The Department has drafted
and made a tentative determination to issue a modified
SPDES Permit No. NY-0000906 for an existing average discharge of 2.1177 million
gallons per day (MGD) of boiler blowdown water, contaminated groundwater,
stormwater runoff, contact and noncontact cooling water from eight outfalls into the
Niagara River via Pikes Creek. The draft permit modification regulates several new
outfalls. Outfalls 003, 005, 007, 008, and 009 have been added in response to the
permittee's July 9, 1992 and February 6, 1997 stormwater permit applications. Outfalls
02A, 02B, and 02C have been added based on Department inspections and on the
permittee's September 15, 1997 data submittal. The draft permit modification includes
both interim and final permit limits, and a compliance schedule for achieving those limits.
The permittee's carbon and graphite products manufacturing plant is located at 5700
Niagara Falls Boulevard.
