PROJECT DESCRIPTION:
The Department has received an Air State
Facility (ASF) permit application from Tri-City
Aggregates for a new 480 square foot enclosed asphalt batch plant facility to be located
at 850 South Pearl Street, Albany, NY.
PERMITS:
The applicant has applied for a New York
State Air State Facility permit under
regulations 6 NYCRR Part 201; NYSDEC application number # 4-0101-00373/00001
PUBLIC HEARING AND WRITTEN COMMENT
PERIOD:
All persons, organizations, corporations
or government agencies which may be affected
by the proposed project are invited to comment on the application. A Legislative Public
Comment Hearing on the application will be held to receive unsworn statements from
the public on Wednesday, May 7, 2003 at 6:30p.m. at the Giffen Elementary School
located at 274 South Pearl Street, Albany.
It is not necessary to file a written request
in advance to speak at the legislative hearing.
Written statements and comments on the application are encouraged and any
statements and comments may be filed prior to or at the hearing, but no later than the
deadline for written comments, which has been extended to May 9, 2003.

This hearing location is reasonably accessible
to persons with a mobility impairment.
Interpreter services may also be made available to deaf persons, at no charge, upon
written request to the Regional Permit Administrator named below, no less than one
week prior to the hearing, pursuant to SAPA § 202(1).
All persons having an interest in this project
are urged to attend or be represented either
individually or collectively.
Following the hearing, the Department will
make a determination on whether substantive
or significant issues have been raised as defined in 6NYCRR Part 621 Uniform
Procedures and an Adjudicatory Hearing Issues Conference should be scheduled
before an Administrative Law Judge. In order to raise substantive and significant issues
written comments expressing objections to or opposition to the application must explain
the basis of that opposition andidentify the specific grounds which could lead the
Department to deny or impose significant permit conditions on the project.

The applicant proposes the
construction of six (6) vertical wells and appurtenances to
augment the previously permitted infiltration gallery, five to seven (5-7) angled wells and
two (2) vertical wells with an objective of obtaining the presently permitted six million
gallons per day. Three of the wells will be located north of the Vloman Kill in the
southern end of Henry Hudson Park and three will be located on State owned land south
of the Vloman Kill. The new wells will be connected to the existing water supply system
and Clapper Road treatment plant. Two of the wells are located within the NYS
freshwater wetland adjacent area and will involve 0.4 acre of temporary impact and 200
square feet of permanent impact. The new water supply lines connecting the wells will
involve directional drilling under the Vloman Kill and result in a temporary wetland
adjacent area disturbance of approximately 0.17 acre.

The applicant proposes to
modify and existing SPDES permit to modify suspended solids
and ammonia limits, and add an ultimate oxygen demand limit. Limits are based upon
meeting water quality standards and maintaining the best use of the receiving stream. The
seasonal limit timeframe has been modified by one month, so that the winter limits
extend through June instead of May. The project is located at the Brunswick Central
School, NYS Route 2, in the Town of Brunswick, Rensselaer County. The Department
has made a tentative determination to issue a modified permit under Article 17 of the
Environmental Conservation Law. This tentative determination indicates that the
discharge regulated under this statute is considered to satisfy regulator standards for
permit issuance, based on information available to the Department at this time. As a
tentative determination, the Departmetn seeks comments on the proposed regulated
activity prior to making a final decision on permit issuance. As such, this tentative
determination does not signify department approval for or endorsement of the activity for
which a permit is sought or for the overall project. Comments will be received for 30 days
from the date of this notice.
