ENB Region 9 Completed Applications 04/23/2003

The applicant proposes to remove gravel from a gravel bar along 400 lineal feet of Mill Creek.  The gravel will be removed by a skimming type operation and all removal will occur above the normal low water elevation of Mill Creek at the site.  The project is located at approximately 3,700 feet northeast of the intersection North Hill and Rood Roads

The applicant proposes to install a steel sheet pile breakwall along 180 feet of Bemus Creek.   The project is located along the applicant’s property, 4030 Popal Lane (Shore Acres), approximately 120 feet upstream of the Bemus Creek and Chautauqua Lake confluence.

The applicant proposes construction and expansion of an irrigation pond by 14 acres, to make a total of 20 acres for the irrigation pond.   The pond will provide irrigation for crops on the Helmich site. Approximately 500,000 cubic yards of soil will be excavated; with most being sold and some used for reclamation on site.  The project site is located at 2752 Ridge Road, approximately 1700 feet west of the intersection of Route 429 and Route 104 (Ridge Road) in the Town of Lewiston, Niagara County.

The Department has made a tentative determination to approve this application for modification of an existing permit for a total of approximately 179,800 gallons per day of treated sanitary wastewater from 58 discharge points (some combined) to groundwater and the Genesee River.  The outfalls are from various treatment systems throughout Letchworth State Park in Wyoming and Livingston Counties, the Towns of Castile, Genesee Falls, Leicester, Mount Morris and Portage.  A draft permit is available for review.  Proposed modifications to the permit are the result of system reconstruction, changes in public use and design standards and the combination of formerly separate outfalls.
