The applicant proposes to
construct a retention pond with a normal storage volume of
approximately 8.5 acre-feet by excavation and the construction of an approximately 13'
high earthen dam. Safety features include a cut-off trench, a concrete junction block
surrounding the sides of the riser and base plate, three anti-seep collars on the outlet pipe,
and a stone-lined plunge pool. Technical design assistance has been provided by the
Chemung County Soil & Water Conservation District and the USDA Natural Resources
Conservation Service. The site is located approximately 0.33 miles south of Dutch Hill
Road, just east of Clark Hollow Road. Application materials are available for public
review and comment at the NYS DEC Regional Office.

The Town of Penfield proposes
to construct Extension 22 to the Consolidated Sewer
District which consists of
the construction of approximately 1,200 lineal feet (LF) of 10-inch
gravity sanitary sewers, 9,080 linear feet of 8-inch gravity sewers, 1,525 LF of force main, one
duplex grinder lift station, and laterals and appurtenant structures to serve approximately 110
existing residences in several areas of the Town of Penfield, including Jackson
Road, Alpine
Drive, Sawmill Drive, State Road, Cobbles Drive, and the Hipp Brook Preserve area. The
project includes crossing the adjacent area of Thousand Acre Swamp with sewer line and the
installation of access roads, including board walks, through the Hipp Brook Preserve. The file

The Department has made
a tentative determination to issue a permit modification to the
State Pollutant Discharge Elimination System permit conditions regulating outfall 013
which discharges non-contact cooling, contact cooling, boiler blowdown, treated process
wastewater and stormwater to the Seneca River and Barge Canal from the Hampshire
Chemical Corporation, a manufacturer of sulfur-based chemicals. The proposed
modification includes eliminating the water quality based effluent limit for total
suspended solids (TDS) and replacing it with a monitoring requirement for TDS and
water quality based effluent limits for chloride and sulfate. Toxicity testing will be
increased from quarterly to monthly to assure toxicity to fish species will not increase. In
addition, chlorine effluent limits will be removed from the permit because the facility no
longer uses chlorine. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy the regulatory requirements for permit issuance.
As a tentative determination, the Department seeks comments on the proposed regulated
activity prior to making a final decision. The file is available for review and comment at
the NYSDEC Region 8 office.

This notice is issued pursuant to 6 NYCRR Parts 617 and 621 of the
implementing regulations pertaining to Article 8 (State Environmental Quality
Review Act) and Article 70 (Uniform Procedures) of the Environmental
Conservation Law.
The New York State Department of Environmental Conservation has determined
that this application is complete and has accepted a draft Environmental Impact
Statement (dEIS) for the action described below. A hearing will be conducted
pursuant to 6NYCRR Part 617 to receive additional comment on this application
and dEIS. The hearing will be held at 7:00 P.M. on 14 May 2003 at the Campbell
Town Hall on Main Street, Campbell, New York.
Name of Action: Smith Farm Gravel Mine, Curtis Hollow Road.

SEQR Status: Type I
Description of Action: The applicant, Dalrymple Gravel and Contracting
Company, Inc., proposes to develop a 134.5 acre sand and gravel mine on a 244.6
acre parcel in the Town of Campbell, Steuben County. The mine will operate as a
traditional surface excavation of sand and gravel by mechanical equipment
standard for this type of mine, including mining below the water table utilizing a
dragline. The excavated material will be washed, screened and crushed. Wash
water will be directed to settling ponds and recirculated for reuse: no surface
water discharges are proposed. Final reclamation will restore the site to open
water recreational ponds. Upland reclamation will include replacement of
stockpiled topsoil and reseeding with an approved USDA SCS seed mixture to
stabilize banks. Unaffected land will remain agriculture or forested.
Location: The proposed mining site is bounded on the south
by Curtis Hollow
Road, on the east and north by the Cohocton River, and on the west by I-86. The
site is located in the Town of Campbell, Steuben County.
Project Review: Pursuant to SEQR, the Region 8 Department Staff,
as Lead
Agency, issued a Positive Declaration for this Type I action on 13 March 2002.
A public scoping meeting was held on 4 April 2002, and final scope was
provided to the applicant on 15 May 2002.
Written comments on the dEIS will be accepted until 27 May 2003. No filing
is
required to speak at the hearing. The hearing location is reasonably accessible to
persons with a mobility impairment. Interpreter services may be available to deaf
persons at no charge. Requests for an interpreter must be made to the contact
person at least 10 business days before the hearing.
The dEIS and other project information are available for your review at the
Regional Office of NYS DEC on 6274 East Avon-Lima Road in Avon, NY. A
copy of the application and dEIS is also available at the Campbell Town Hall.
