The
applicant is currently authorized to discharge 120 million gallons per day (30 day
arithmetic mean) of treated sanitary wastewater to the Hudson River from its Yonkers
Joint Wastewater Treatment Plant located at 1 Fernbrook Street, Ludlow Dock South in
the City of Yonkers. Various combined sewer/stormwater overflow outfalls are also
authorized under this permit. This permit was renewed on December 1, 1998 with an
expiration date of June 1, 2004 under the Department's Environmental Benefit Permit
Strategy (EBPS) program.
The
permittee has submitted its detailed application under the EBPS for review by the
Department. Based upon this application, the Department has made a tentative
determination to issue a modified permit for a State Pollutant Discharge Elimination
System permit under Article 17 of the Environmental Conservation law. This tentative
determination indicates that the discharge regulated under this statute is considered to
satisfy regulatory standards for permit issuance, based on information available to the
Department at this time. As a tentative determination, the Department seeks comments
on the proposed regulated activity prior to making a final decision on permit issuance.
A
draft permit has been prepared by the Department and is available for public review.

The
Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution
Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal
Clean Air Act Amendments and made a tentative determination to approve this
application for the Applicant's facility located in Tarrytown, Westchester County.
This
is an existing hot mix asphalt (HMA) batch plant. Liquid asphalt, various sizes of
aggregate, sand and recycled asphalt pavement (RAP) are combined to produce HMA.
Liquid asphalt is stored in heated above ground tanks each with a capacity of 25,000
gallons. Aggregate, sand, and RAP are stored in stockpiles on site. The aggregate and
sand are heated in a rotary dryer and then blended in a pug mill to produce HMA. The
dryer is vented to a bag house. The finished HMA is either loaded directly into trucks or
transferred to storage silos. The dryer can run on either #2 fuel oil or specification waste
oil (waste fuel oil or specification waste oil (waste fuel A).
By
acceptance of this permit, the permittee agrees that the permit is contingent upon
strict compliance with the ECL, all applicable regulations, the General Conditions
specified and any Special Conditions included as part of this permit.
The
Application and Draft Permit are available for review at the Regional Office of the
New York State Department of Environmental Conservation.
