The applicant proposes to
modify their existing County-wide Article 15 General Permit
in order to better address stream impairments by employing natural stream design
methodologies. The modification of the General Permit would allow for focus on process
and not just structure, with the understanding that complex ecosystem and associated
habitat feature stabilization and restoration cannot be achieved via the simple and
artificial manipulation of selected components. In accordance with this philosophy, the
General Permit modification will allow for limited Article 24 Freshwater Wetland
activity coverage and will increase the coverage thresholds for Article 15 activities,
allowing application of these natural design concepts over longer reaches of streams and

Garrett Landing LLC proposes
to redevelop a 2.15 acre site at 1 Lake Street by removing
an abandoned warehouse and creating the proposed Garrett Landing facility. They
propose to construct a three-story townhouse building containing 26 townhouse units,
repair 50 linear feet of existing vertical breakwall, stabilize the eastern shoreline with
riprap (above the mean high water level), maintain an existing dock, add 445 linear feet
of new dock and board walk on piles, add 384 linear feet of new slips, construct a new
access drive from Water and Mill streets, and construct new wastewater and stormwater
treatment systems. The applicant proposes to discharge approximately 6,400 gallons per
day of treated sanitary effluent from a Bioclere treatment plant to groundwater. The
Department has made a tentative determination to issue a SPDES permit for the sanitary
effluent as the proposed discharge has been determined to meet standards for permit
issuance. As a tentative determination, the Department seeks comments on the proposed
regulated activity prior to making a final decision. The site stormwater will be required to
meet the General Permit for Construction water quality conditions. The file is available
for review at the NYSDEC Region 8 office. The Department will respond to comments
pertaining to Article 15 (Excavation and Fill), Article 17 (SPDES) permits and other state
statutory requirements.
