Landfill Area #4 is prohibited under 6 NYCRR 360-9.4(a)(7) from having a landfill
constructed on the State funded landfill closure project. No change in operations is being
proposed.

The applicant proposes a
new discharge of 6500 gpd of treated sanitary and cooling water
to Claverack Creek from a primary treatment plant at the applicant's facility located at the
COARC-Mellenville, State Route 217 in Mellenville, Town of Claverack, Columbia
County. The applicant plans to replace an existing failed system at an existing facility.
The Department has made a tentative determination to issue a permit for a State Pollutant
Discharge Elimination System permit under Article 17 of the Environmental
Conservation Law, as well as an Article 15 Protection of Waters permit for the
construction of the outfall at Claverack Creek. This tentative determination indicates
that the discharge regulated under this statute is considered to satisfy regulatory standards
of permit issuance, based on information available to the Department at this time. As a
tentative determination, the Department seeks comments on the proposed regulated
activity prior to making a final decision on permit issuance. As such, this tentative
determination does not signify department approval for or endorsement of the activity for
which a permit is sought or for the overall proposed project. A draft permit is available
for inspection and comment at the Region 4 Office. Refer to the application number

conduct a wetland enhancement project under the USDA
Wetland Reserve Program. The project consists of constructing two low bermed potholes
and excavating 4 potholes within freshwater wetland SV-30 and its adjacent area to

potholes will average 2 feet in depth with varying areas from 3,500 square feet to 18,000
square feet. The project is located on Furnaceville Road approximately 3/4 miles west of

project involves the excavation of 2 potholes within the adjacent area of Freshwater
Wetland OT-5. Each pothole will be approximately 0.1 acre in size and 1.5 to 2.0 feet in
depth. Excavated material will be spread near the potholes or formed to create low
loafing islands. The purpose of the project is to enhance the hydrology of the site and
increase the diversity of the habitat. The project is located north of the hamlet of Otsdawa
and east of Bert Washburn Road and west of Mud Road.
