The applicant proposes to modify the existing
mining permit and mined land use plan
(MLUP) for their sand and gravel mine located on NYS Route 64 in the Town of West
Bloomfield, Ontario County. The modification consists of a request to add a six acre
stockpile area to the life-of-mine acreage. The expansion will not cause any additional
change in the nature of the operation at this facility. The newly reviewed life-of-mine
area for this modification will increase the existing 110.9 acre permitted life-of-mine by 6
acres to 116.9 acres. Application materials are available at the Regional Office of NYS
DEC for public review and comment.

The Department has received an application
described as follows, and will approve it
unless comments received by the date specified at the end of this notice raise significant
issues not addressed by the application.
The application, by Corning Inc, is to establish
certified Emission Reduction Credits
(ERC) in accordance with 6 NYCRR Part 231 New Source Review in Ozone Transport
Regions. These ERC are based on the permanent shutdown, effective November 22,
2002, of the Fallbrook Plant, located on Tioga Avenue in the City of Corning.
The Fallbrook Plant produced borosilicate,
alumina silicate, and lead glasses, and
fabricated glass tubing and electron gun necks. It was subject to 6 NYCRR Part 201-6
(Title V) due to potential emissions of oxides of nitrogen (NOx), total particulates, and
particulates smaller than 10 microns (PM10) in excess of 100 tons per year each; total
hazardous air pollutants (HAP) in excess of 25 tons per year; and individual HAP
compounds hydrogen fluoride (HF) and hydrogen chloride (HCl) in excess of 10 tons
per year each.
The ERC from the Fallbrook Plant shutdown
will be certified for 187.03 tons per year of
oxides of nitrogen (NOX), to be used as emission offsets at the Corning Canton Plant in
the Town of DeKalb in St. Lawrence County.
The ERC will be certified with Conditions
that identify the source and quantity of the NOX
ERC, and that prevent future operation of emission sources at the Fallbrook Plant.
The application is available for review
at the both the Department of Environmental
Conservation Central Office in Albany, and the Region 8 Department of Environmental
Conservation Office in Avon.
