The Department has made a tentative determination to issue a State Pollutant Discharge Eliminatio System permit under Article 17 of the Envronmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is
considered to satisfy regulatory standards for permit issuance, based on information
available to the Department at this time. As a tentative determination, the Department
seeks commments on the proposed regulated activity prior to making a final decision on
permit issuance. As such, this tentative determination does not signify Department
approval for or endorsement of the activity for which a permit is sought or for the overall
proposed project.

The Department has received a complete application and has developed a draft permit that replaces existing emission point permits at the Agri-Mark Inc. facility. The draft permit establishes facility wide emission caps of 90 tons per year for sulfur dioxide and nitrogen oxides. These caps are below the major source level thus exempting the facility from Title V permit requirements. The permit also establishes new record keeping and reporting
requirements and includes procedures to prevent off-site nuisance odors. The draft permit
is available by contacting Michael Sundberg of the Division of Air Resources staff in the
Region 5 Warrensburg office at (518) 623-1212.

The applicant proposes to construct a 90'X 30' residence, metal storage barn on a concrete slab and a well 50' into the 100' buffer of NYS Wetland F-7 (Class 2).
Excavation and placement of fill will occur in the 100' buffer area. In addition,
approximately 300 cubic yards of sand and gravel fill plus a culvert will be used to create
a road through the wetland and buffer to access the rear of the property. The purpose of
locating the residence further back on the lot is to reduce road noise and create a better
area for construction.
