The applicant proposes to
modify portions of Freshwater Wetland SL-3 (Class I) and the
100 foot adjacent area in order to replace approximately 2700 linear feet of 10 inch
diameter natural gas pipeline (Pipeline A-5) due to deterioration of the existing pipeline.
The proposed natural gas pipeline replacement will also cross the Indian Kill Reservoir
(Class A) within an existing right-of-way. Activities proposed within the Freshwater
Wetland and its adjacent area include clearing of vegetation, snags and obstacles,
trenching in upland areas, and construction of the replacement pipeline. The total area of
disturbance to the wetland is approximately 0.23 acre; the total area of disturbance to the
adjacent area is 1.27 acre. The pipeline replacement project will begin at an existing gas
meter station north of Sterling Lake Road (County Route 84), proceed northwest across
Freshwater Wetland SL-3 (Indian Kill Reservoir) and terminate at a point south of NYS
Route 17A in the Town of Tuxedo, Orange County.

The Department has made a tentative determination to approve this application for a new SPDES permit for an existing surface discharge from an outfall (No. 001) with a
maximum daily flow of 2400 gallons per day (gpd) from a hydroelectric generating
facility fed by the East Delaware Aqueduct located near the northern terminus of Rondout
Reservoir (Class AA). Outfall No. 001 reflects a discharge of water used to cool the
turbine shaft bearing at the applicant's hydroelectric generating facility: cooling water is
collected in a sump and pumped to an oil/water separator for treatment prior to discharge
to the tail race upstream of the Rondout Reservoir. The project involves no new
construction and is located at existing water supply facilities (owned by the NYCDEP)
east of NYS Route 55A, approximately 2000 feet south of Sugarloaf Road in the Town of
Neversink, Sullivan County. A draft permit is available for inspection and comment at the
regional office.

The Shattemuc Yacht Club has applied for a permit to install up to 600 feet of new bulkhead along its existing deteriorated sunken perimeter barges and a deteriorated sunken circle line boat to prevent damaging waves and storm surges from flushing through the marina. The base of the new bulkhead will extend up to 4 feet waterward of these deteriorated structures in order to allow for use of angular supporting piles, called "batter piles". The outside of the driven piles will be covered with either interlocking steel sheeting or wooden timber sheeting. Shattemuc also proposes to drive additional piles along the outside of approximately 220 feet of the existing North Wall to reduce the maximum separation distance between piles to no more than a 10 feet.
The Shattemuc Yacht Club is located on the east shore of the Hudson River off Westerly Road, just west of the Snowden Avenue Bridge, in the Village/Town of Ossining, in Westchester County, NY.
