The
applicant proposes an existing 500 gallons per day (GPD) (maximum) discharge of
treated vehicle wash water to Marsh Creek, a Class C (T) stream, from a grit chamber and
oil/water separator treatment plant at the applicant's Allegany West Sub-Headquarter's
facility located at Hardy Hill Road, one tenth mile north of East Valley Road, Andover
New York. The facility also has a 200 GPD (maximum) treated sanitary wastewater
discharge to groundwaters, (Class GA).
The
Department has made a tentative determination to issue a permit for a State
Pollutant Discharge Elimination System permit under Article 17 of the Environmental
Conservation law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
department approval for or endorsement of the activity for which a permit is sought or for
the overall proposed project.

The
applicant proposes a modification of SPDES Permit NY-002 0621 for a discharge
of 2.2 million gallons per day (MGD), which is an increase from the previously permitted
1.5 MGD of treated municipal wastewater to the Genesee River, a Class C (T)
waterbody, from a secondary wastewater treatment plant at the applicant's facility located
at Bolivar Road (NY Rt. 17W) west of the Genesee River. Other proposed changes in the
draft permit include: the deletion of outfalls# 4, 5, 7, and 8 since they have been
eliminated; Outfall 006 (emergency bypass outfall) has been renumbered to Outfall 002;
the pH limiting range has been changed from 6.0-9.0 to 6.5-8.5; effluent limitation of 4.2
lbs/day for zinc replaces an action level; and an action level of 7.5 lbs./day for aluminum
replaces an effluent limit.
The
