ENB Region 8 Completed Applications 03/05/2003

The applicant proposes to expand an existing 6 acre surface clay mine an additional 8 acres within a 49.6 acre parcel south of Galloway Road approximately 1400 feet west of the Kelsey Road intersection in the Town of Batavia.  The mine currently operates as a traditional surface extraction of the Cazenovia and Ovid series of silty clay sandy loams which are the predominate soil type on the site.  Mining is proposed for both above and below the local water table.   Excavation will be done by mechanical equipment, standard for this type of mining operation.  Mining is proposed to remove approximately 150,000 cubic yards of material over the operational life of the mine.  Final reclamation will include the replacement of stockpiled topsoil, and reseeding with an approved USDA NRCS seed mixture to create a grassland/shrub habitat including a two acre pond.  The reviewed life-of-mine expansion area is 8 acres. The applicant proposes to expand an existing 10 acre marl mine by approximately 2.3 acres within the wetland and adjacent area of Freshwater Wetland CH-30.  The project site is the applicant’s property on the west side of Route 19 and south of the NYS Thruway in the Town of LeRoy, Genesee County.  The mine operates as a surface extraction of marl and excavation will occur using typical mining equipment for the removal of material below the local water table. Mining will remove approximately 20,000 cubic yards of material over the remaining operational life of the mine.  Material will be processed with a nonmechanical screen as needed. Final reclamation will restore the site to an open water surface, with uniformly graded and revegetated upland.  Reclamation will include the replacement of stockpiled topsoil, creation of irregular shorelines, nesting islands, level ditches and potholes, and reseeding with an approved USDA NRCS seed mixture.  The expanded life-of-mine area is 2.3 acres.  Application materials are available for public review and comment at the Regional Office of NYS DEC.
