The site includes 20, 22, 24, and 30 Avalon Trail. As part of the project the applicant has proposed to upgrade the existing private drive, construct a 50 ft. X 4 ft. dock on Irondequoit Bay, and install a low pressure force main for sewage disposal.The site development for the residence will all be within the 300 ft. adjacent area (extended from 100 ft.) of the of NYS Freshwater Wetland RE-1 (I).
State Environmental Quality Review (SEQR) Determination:
Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.
SEQR Lead Agency:
Penfield Town Planning Board
State Historic Preservation Act (SHPA) Determination:
Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management:
This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:
The NYSDOT has submitted an application relating to the construction of a new 4 lane highway on the west side of the Tioga River valley between Lawrenceville Pa. and Presho, NY. The six miles of roadway will impact wetlands . The NYSDEC and the NYDOT have jointly developed a plan to mitigate the impact . It is planned to construct a 6.8 acre wetland east of Orcutt Road and west of the Tioga River near the Hamlet of Lindley. A car top boat /canoe launch site is part of the plan. In addition a 5.5 acre wetland is proposed north of Tannery Creek where it enters the Tioga River. This site is 1.5 miles north of the Hamlet of Lindley on the east side of the Tioga River. At least two vernal pools will be constructed at other locations. The permit when issued will be conditioned so that NYSDEC will have final plan review opportunity. The NYSDOT has developed an acceptable plan to mitigate cultural resource impacts.

A draft environmental impact statement has been prepared on this project and is on file.

NYS Dept of Transportation
State Historic Preservation Act (SHPA) Determination:
A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
