NEW YORK STATE DEPARTMENT OF ENVIRONMENTAL CONSERVATION (Department)

6 NYCRR Part 210, Emissions and Labeling Requirements for Personal Watercraft Engines, and Part 200 General Provisions

The Department proposes to promulgate a new Part 210, entitled, Emissions and Labeling Requirements for Personal Watercraft Engines, and repeal existing Part 210, Centrally Fueled Fleets, an expired emergency regulation. Implementation of a personal watercraft emissions reduction program is mandated by ECL 19-0306a. The program is designed to reduce hydrocarbons and oxides of nitrogen emissions from all new personal watercraft, and is required to be consistent with California air emissions reduction and labeling regulations for new spark ignition marine engines for use in personal watercraft.

Pursuant to Environmental Conservation Law (ECL) Sections 1-0101, 3-0301, 19-0103, 19-0105, 19-0301, 19-0303, 19-0305, 71-2103, and 71-2105, the Department hereby gives notice of the following public hearings:

Hearings are scheduled in places that are reasonably accessible to persons with impaired mobility. The Department will provide interpreter services for deaf persons at no charge. The Department invites all persons, organizations, corporations, and government agencies that may be affected by the proposed revisions to attend the hearings. At each hearing, persons who wish to make a statement will be invited to speak. It is requested that oral statements also be submitted in writing. The Department will give equal weight to written and oral statements, and since a cumulative record will be compiled it is not necessary for interested parties to attend each hearing.

Negative Declaration

Erie County: The Planning Board of the Town of Amherst, as lead agency, has determined that the proposed Site Plan Review: East Amherst Fire Hall Expansion will not have a significant adverse environmental impact. The action involves a 5,520 sq. ft. addition to the existing East Amherst Fire Hall, construction of a 1,440 sq. ft. storage shed, construction of an additional 51 parking spaces, reconfiguration of an existing parking area, and construction of a new curb cut on Transit Road. The property is zoned Community Facilities (CF) and measures 7.29 acres; approximately 4.9 acres of the site will remain undeveloped. The parcel is located on the west side of Transit Road and is bisected by Muegel Road.

Erie County - The Planning Board of the Town of Amherst, as lead agency, has determined that the proposed Site Plan Review: The Chapel on North Forest Road - Parking Lot Expansion will not have a significant adverse environmental impact. The action involves adding 117 new parking spaces to the existing 490-space parking lot, for a total of 607 spaces. The Chapel complex consists of a worship center, adjoining Family Center, two residential buildings and garage. The property occupies a 13 acre site on the east side of North Forest Road, between Sheridan Drive and the Ellicott Creek crossing. The property is directly adjacent to Ellicott Creek with 1000 feet of frontage. The project area consists of 0.69 acres (30,200 sq. ft.) of asphalt pavement for parking and access. The project is located at 895 North Forest Road, Amherst.

Notice of Acceptance of Final EIS

Wyoming County - The Town of Sheldon, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Shur-Gain USA, Inc. Facility Expansion. The action involves Shur-Gain USA, Inc. which is a producer of animal feed products will be demolishing the existing mill building and construction a new larger, updated mill building. The new mill building will increase mixing and processing time, allowing for greater output quantity from the facility. In conjunction, addition existing support building and storage bins will be moved, demolished or left in place. The project is located at 3422 Dutch Hollow Road, Strykersville, New York.
