NEW YORK STATE DEPARTMENT OF ENVIRONMENTAL CONSERVATION (Department)

6 NYCRR Part 210, Emissions and Labeling Requirements for Personal Watercraft Engines, and Part 200 General Provisions

The Department proposes to promulgate a new Part 210, entitled, Emissions and Labeling Requirements for Personal Watercraft Engines, and repeal existing Part 210, Centrally Fueled Fleets, an expired emergency regulation. Implementation of a personal watercraft emissions reduction program is mandated by ECL 19-0306a. The program is designed to reduce hydrocarbons and oxides of nitrogen emissions from all new personal watercraft, and is required to be consistent with California air emissions reduction and labeling regulations for new spark ignition marine engines for use in personal watercraft.

Pursuant to Environmental Conservation Law (ECL) Sections 1-0101, 3-0301, 19-0103, 19-0105, 19-0301, 19-0303, 19-0305, 71-2103, and 71-2105, the Department hereby gives notice of the following public hearings:

Hearings are scheduled in places that are reasonably accessible to persons with impaired mobility. The Department will provide interpreter services for deaf persons at no charge. Written requests for interpreter services are required and should be submitted by February 24, 2003, to Arlene Schmidt, NYSDEC, 625 Broadway, Albany NY 12233-3250, 518 402-8465,

The Department invites all persons, organizations, corporations, and government agencies that may be affected by the proposed revisions to attend the hearings. At each hearing, persons who wish to make a statement will be invited to speak. It is requested that oral statements also be submitted in writing. The Department will give equal weight to written and oral statements, and since a cumulative record will be compiled it is not necessary for interested parties to attend each hearing.

Negative Declaration

Oswego County - The Town Board of the Town of Mexico, as lead agency, has determined that the proposed Purchase of Clark Concrete Company properties, Tubbs Road and Valley Road, Towns of Mexico and Richard will not have a significant adverse environmental impact. The action involves purchase of 100 plus or minus acres from Clark Concrete Company for continued limited use by Town as gravel bed, also possible future use of aquifer on properties. The project is located on Tubbs Road and Valley Road, Towns of Mexico and Richland.

Tompkins County - The Board of Trustees of the Village of Groton, as lead agency, has determined that the proposed Local Law amending Zoning Law (Local Law No. 12 of 2003) will not have a significant adverse environmental impact. The action involves a local law amending the Code of the Village of Groton, Zoning, Relating to Vegetated Buffer Areas for Special Commercial Districts. The project is located village-wide.
