ENB Region 3 Completed Applications 01/29/2003

The applicant proposes to construct a driveway across an unnamed tributary of Masonic Creek (Class B) and Freshwater Wetland MD-9 (Class II) in conjunction with the construction of a two family residence on an existing 5.4 acre lot.  Approximately 3,295 square feet of wetland is proposed to be filled for the driveway.  The project site is located on the east side of Midland Lake Road approximately three tenths of a mile southwest of its intersection with Goshen Turnpike (County Route 101).

The applicant proposes to construct noise barriers along Interstate 87/287 within the 100-foot adjacent areas of State-designated Freshwater Wetland Nos. PR-5 (Class II) and PR-7 (Class ).  The project site is located along the southbound side of the NYS Thruway from approximately 1,000 feet west to 1,400 feet east of the crossing of North Middletown Road (Co. Route 33).  Construction of the noise barriers will require the disturbance of approximately 0.07 acre and 0.12 acre of the 100-foot adjacent areas of Freshwater Wetlands PR-5 and PR-7, respectively.

The applicant proposes to install two roadway crossings, three pedestrian foot bridges, and one 8-inch diameter sewer line crossing within a tributary of Sheldrake Pond (DEC Water Index No. D-1-38-P51-1; Class B).  The project involves the construction of a 49-unit condominium community to be known as Evergreen Estates on a 24.7-acre parcel of land located northeast of the intersection of Maplewood Ave. (Town Rd. #124) and Karmel & Jacobs Rd. (Town Road #58).  A single arch culvert inches wide by 55 inches high by 50 feet long will be installed at each proposed road crossing.  Each footbridge will be a wooden structure 6 feet wide supported on posts located on the stream banks. The project will also involve the permanent filling of approximately 0.41 acres of federally regulated wetlands on the site.  As mitigation for wetland losses, approximately 0.56 acres of wetlands will be created on the site.

The applicant proposes to develop an existing lot which contains portions of Freshwater Wetland H-3 (Class 3).  Activities proposed within the 100 foot adjacent area of the wetland consists of portions of the fill areas for both the primary and reserve septic system areas proposed to serve a three bedroom house.  The project site is located on the south side of Swarte Kill Road approximately mid way between its intersection with Floyd Ackert Road and Old Post Road.
